HomeMy WebLinkAboutR-2001-024 Commencing South 72nd Avenue AnnexationA Resolution RESOLUTION NO. R 2001- 24 concerning annexation, and commencing the South 72nd Avenue Annexation by the petition method of annexation. WHEREAS, RCW 35.13.125 - .160 authorizes the City of Yakima to annex territory on the basis of property owners' petitions for annexation; and WHEREAS, the City has, pursuant to the 1976 Agreement for Wastewater Treatment and Disposal Services ("4 -Party Agreement"), extended wastewater collection and treatment service to unincorporated properties on the basis of contracts known as Outside Utility Agreements (OUAs), in which utility service is extended to property outside the City on the condition that the owner commit the property to annexation by the petition method; and WHEREAS, the City has entered into OUAs with the owners of property that constitutes at least 10% of the assessed value in the area depicted on the attached map entitled "South 72nd Avenue Annexation," which is incorporated by reference; and WHEREAS, the OUAs between the City and the owners of properties in the area designated as the "South 72nd Avenue Annexation" are the substantial equivalent of written notice of intent, as described in RCW 35.13.125, to commence annexation proceedings for the South 72nd Avenue Annexation; and WHEREAS, RCW 35.13.125 authorizes the City Council, upon written notice of intent to commence annexation proceedings from the owners of property that constitutes at least 10% of the assessed value in the area, to determine whether or not to commence annexation proceedings for the area; and WHEREAS, RCW 36.93.090 requires that the City file a notice of intent with the Washington State Boundary Review Board for Yakima County when the City commences an annexation such as the South 72nd Avenue Annexation; and WHEREAS, it is in the best interests of the City of Yakima and the area designated "South 72nd Avenue Annexation" that the City Council accept the South 72nd Avenue Annexation as a proposed annexation to proceed by the petition method as authorized by law; now therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Council accepts the South 72nd Avenue Annexation on the basis of the Outside Utility Agreements which have been formed between the City and the owners of properties in the area designated as the South 72nd Avenue Annexation and commences proceedings for the South 72nd Avenue Annexation by the petition method as authorized in RCW 35.13.125 - .160, on the basis of Outside Utility Agreements. The area to be annexed shall remain subject to the Yakima Urban Area Comprehensive Plan and shall assume its share of the City's existing indebtedness. Cook, Director of Community Economic Development CONTACT PERSON / TELEPHONE: Bruce Benson, Associate Planner, 575-6042 SUMMARY EXPLANATION: The proposed " South 72' Avenue " Annexation Area consists of approximately 986 acres including 1815 tax parcels (see map), which are worth $237,483,340 according to current Yakima County assessed valuation. The population of the area is estimated to be 5075 persons. This annexation is based upon Outside Utility Agreements from 1,341 of the 1,815 parcels. The combined assessed value of these 1,341 parcels is 77% of the area's total assessed value. This 77% satisfies both the RCW 35.13.125 requirement for initiation of an annexation, (10% of the assessed value of the annexation area) and the RCW 35.13.130 requirement for completion of an annexation (75% of the assessed value of the area). At this time City Council is being asked to act upon this request and adopt the resolution initiating the South 72"d Avenue.
