HomeMy WebLinkAboutR-2001-021 Collection of Solid Waste in Areas AnnexedRESOLUTION No. R 2001- 21 A Resolution relating to collection of residential solid waste from properties annexed since 1995, and declaring the City of Yakima's policy to decide, on a case by case basis, whether to provide solid waste collection service to residences in such annexed areas immediately upon expiration of the RCW 35.13.280 franchise period, or whether to delay assumption of such responsibility until necessary personnel, equipment, and routes can be economically provided, in reliance upon the automatic reinstatement of the WUTC authority under which such areas were served before annexation. Whereas, Yakima Waste Systems, Inc. ("YWSI") is, and has since before 1995 been, the firm authorized by the Washington Utilities and Transportation Commission ("WUTC") to provide solid waste collection service in unincorporated territory adjacent to the City of Yakima; and Whereas, YWSI currently provides, under franchise required by RCW 35.13.280, solid waste collection service to residences in areas annexed into the City of Yakima since 1995; and Whereas, each current RCW 35.13.280 franchise contains a specific expiration date, after which the City intends to provide solid waste collection service to residences the in such annexed areas; and Whereas, the City understands that if it chooses, upon the expiration an RCW 35.13.280 franchise, to delay assumption of responsibility for solid waste collection service to some residences in an annexed area until necessary personnel, equipment, and routes can be economically provided by the City, the WUTC authority under which YWSI provided solid waste collection service prior to the annexation will be automatically reinstated; and Whereas, YWSI is willing to provide residential solid waste collection service after the expiration of the RCW 35.13.280 franchise and under automatically reinstated WUTC authority until necessary personnel, equipment, and routes can be economically provided by the City; and Whereas, it is in the best interests of the City to determine on a case by case basis whether to provide solid waste collection service to residences in annexed areas immediately upon expiration of the RCW 35.13.280 franchise period, or whether to delay assumption of such responsibility until necessary personnel, equipment, and routes can be economically provided by the City, in reliance upon the automatic reinstatement of Yakima Waste System, Inc.'s Washington Utilities and Transportation Page 1 of 2 Commission authority, under which such areas were served before annexation; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The policy of the City of Yakima shall be to determine on a case by case basis whether to provide solid waste collection service to residences in annexed areas immediately upon expiration of the RCW 35.13.280 franchise period, or whether to delay assumption of such responsibility until necessary personnel, equipment, and routes can be economically provided by the City, in reliance upon the automatic reinstatement of Yakima Waste System, Inc.'s Washington Utilities and Transportation Commission authority, under which such areas were served before annexation. At that time, City Council directed staff to proceed with assuming service in the East Mead area because it required no additional staff or equipment. However, staff was to create the framework to provide for customer service certainty in consideration of both Yakima Waste Systems, Inc. and the City of Yakima's respective capital and operational plans. This process may include continuing residential solid waste collection service with Yakima Waste Service, Inc. after the statutory period (seven years after formal annexation). This Resolution will allow staff to determine, with sufficient lead time, whether to assume the responsibility for collection or whether to delay assumption of such responsibility until it is economically feasible. Yakima Waste Systems, Inc. would be notified within a reasonable length of time of the City's decision. For example, the City anticipates assuming service for three small annexations becoming effective March 1, 2001 (see attached Annexations 1988-2000 list); however, larger areas such as the East and West Willow Annexations will continue to be serviced by Yakima Waste Systems, Inc. Determination of future annexations depends on how aggressively City Council directs staff to pursue automated service.
