R-2001-19 A RESOLUTION authorizing the purchase of two portable above -ground vehicle lifts from Talon Industries, Inc. for a purchase price not to exceed $43,150.00 (plus sales tax) as pollution control equipment not requiring a bid process. WHEREAS, Article VI, Section 6 of the City of Yakima Charter and the Yakima Municipal Code Chapter 1.80 generally require that purchase of equipment, materials, or services in excess of $25,000 be done by competitive bid, subject to certain exceptions; and WHEREAS, RCW 70.95A.090 provides an exception from these competitive bidding requirements for the sale and purchase of pollution control facilities; and WHEREAS, RCW 70.95A.020(2) defines pollution control facility to include equipment "which is used or to be used by any ... municipality in furtherance of the purpose of abating, controlling or preventing pollution"; and WHEREAS, the Public Works Department requires the purchase of two portable above- ground vehicle lifts to replace existing in -ground hydraulic vehicle lifts to abate, control or prevent pollution from said in -ground lifts; and WHEREAS, Talon Industries, Inc. is willing to provide two portable above -ground vehicle lifts to the City of Yakima for a total price of not more than $43,150.00 (plus sales tax); and WHEREAS, the City Council finds that it is in the best interest of the City to authorize purchase of said portable above -ground vehicle lifts without callings for bids, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized and directed to purchase two portable above- ground vehicle lifts from Talon Industries, Inc. for a purchase price not to exceed $43,150.00 (plus sales tax) as pollution control equipment not requiring a bid process. Washington State Department of Ecology pollution control regulations require that in - ground storage tanks and hydraulic systems be monitored to prevent groundwater pollution. In this case, the hydraulic fluid used to operate the existing lifts would be removed and the function of the existing lifts would be replaced by portable, above- ground lifts in order to abate, control or prevent this pollution situation. In the fall of 1999, prior to the final 2000 budget adoption, a potential groundwater pollution threat was identified in the Equipment Rental maintenance shop. This concern is from the hydraulic systems of our twenty year -old -plus in -ground hoist systems. At that time a program was designed to eliminate the threat by replacing the in -ground systems with portable multi -column and floor mounted lifts. The first set of lifts was purchased in 2000 under a special agreement with the vendor, Talon Industries, Inc., P.O. Box 230021, Portland, Oregon, 97281-0021. Management determined, after research, that these lifts would become the model to be used as our standard for future purchases. nueci ... RESOLUTION No. R-2001-19 Page Two This proposal is for the purchase of two additional sets of lifts which will allow the City to decommission the in -ground hoist systems as soon as these new lifts, along with two new floor mounted lifts are operational. Funds for this project have been budgeted in the 2001 Environmental Fund. The purpose of this Fund is to provide a funding source for complying with rules and regulations imposed by Federal and State mandates regarding underground storage tank operations, hazardous waste disposal, site cleanup, and other environmental compliance issues. The cost of this part of the project and for this sole source request is $43,150, plus sales tax. Application of provisions of State Pollution Prevention Exemption laws allow for the purchase of equipment for the purpose of abating, controlling or preventing pollution without utilizing the formal bid process.
