A RESOLUTION denying the appeal by Lori Frymier of the Hearing Examiner's
March 31, 1999, Decision dismissing the February 3, 1999, Notice of
Noncompliance addressed to Harry D. Rainford regarding the
hours of operation of Rainford's Lube & Oil business at 3310 W.
Nob Hill Blvd.
WHEREAS, on April 15, 1999, Lori Frymier appealed the Hearing Examiner's Decision
(Examiner No. IU99-1-6, UAZO Appeal 2-99) dated March 31, 1999, dismissing the
February 3, 1999, Notice of Noncompliance addressed to Harry D. Rainford regarding
the hours of operation of Rainford's Lube & Oil business at 3310 W. Nob Hill Blvd; and
WHEREAS, on July 6, 1999, this appeal was considered by the City at a duly convened
closed -record hearing, which was continued several times, and which was concluded on
November 7, 2000; and
WHEREAS, after considering the record established during the appeal heard by the
hearing examiner, the arguments of the appellant, interested parties and the public, the
City Council decided by motion to affirm the Hearing Examiner's March 31, 1999,
Decision dismissing the February 3, 1999, Notice of Noncompliance addressed to Harry
D. Rainford regarding the hours of operation of Rainford's Lube & Oil business at 3310
W. Nob Hill Blvd; now, therefore:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Lori Frymier's appeal of the Hearing Examiner's March 31, 1999, Decision (Examiner
No. IU99-1-6, UAZO Appeal 2-99) dismissing the February 3, 1999, Notice of
Noncompliance addressed to Harry D. Rainford regarding the hours of operation of
Rainford's Lube & Oil business at 3310 W. Nob Hill Blvd is denied as of November 7,
2000.
ADOPTED BY THE CITY COUNCIL this 21st day of November, 2000.

SUMMARY EXPLANATION:
On November 7, 2000 the City Council conducted a Closed record hearing to consider
an appeal filed by Ms. Lori Frymier of the Hearing Examiner's decision on an appeal by
Harry Rainford on a Notice of Noncompliance concerning 3310 W. Nob Hill Boulevard.
The Council voted unanimously to deny the appeal and uphold the Hearing Examiner's
decision to dismiss an appeal of a Notice of Noncompliance by Harry Rainford issued
by the City Code Administration Division.
