R-2000- 105 A RESOLUTION declaring an emergency and authorizing the purchase of a chiller unit for the City of Yakima Police Station/Legal Center without calling for bids. WHEREAS, Article VI, Section 6 of the City of Yakima Charter and the Yakima Municipal Code Chapter 1.80 generally require that purchase of equipment, materials, or services in excess of $25,000.00 be done by competitive bid, subject to certain exceptions; and WHEREAS, the law recognizes an emergency exception from these competitive bidding requirements in the event of an emergency; and WHEREAS, the main chiller providing air conditioning for the City of Yakima Police Station/Legal Center has malfunctioned and cannot be satisfactorily repaired; and WHEREAS, due to the malfunctioning chiller unit, many employees and persons with business in the Police Station/Legal Center are experiencing afternoon temperatures of between 85° and 90° fahrenheit, thereby significantly impairing the function of essential public safety services, and WHEREAS, the conditions present a real, immediate threat to the proper performance of essential functions of the City government, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Council declares an emergency situation to exist necessitating the immediate purchase and acquisition of a new chiller unit for the Police Station/Legal Center, and the City Manager is authorized and directed to purchase a new chiller unit for the Police Station/Legal Center for a purchase amount not to exceed $125,000.00 from the Law and Justice Capital Fund without calling for bids. Light, 576-6549 SUMMARY EXPLANATION: The City of Yakima Police Station / Legal Center experienced a critical mechanical breakdown within the existing HVAC system when an essential compressor within the chiller failed. Proper climate controls for efficient and safe operations of the facility are essential. All employees and visitors with the facility are impacted, with the greatest concern being in the public access areas of the Municipal Court and in the secure areas of the Jail. This failed compressor cannot be repaired and replacement is required. If replaced, there will be no warranty offered or implied on the replacement compressor and any future failures with associated repair costs will be the burden of the City. Additionally, this will be the second compressor installed in this Chiller since it was new, 5 '/ years ago. The other replacement compressor and the rebuilding of original equipment compressors were covered by warranty This Chiller unit has a history of frequent failures and high maintenance It does not adequately perform to the required needs of the facility and is not reliable Replacement of the entire HVAC chiller unit is recommended. The attached Resolution authorizes an emergency purchase of a new chiller and waives the bid requirement. The attached Ordinance establishes an appropriation in the Law and Justice Capital Fund of $125,000 for this purchase.
