R-2000-7 A RESOLUTION declaring an emergency in that the Refuse Division has an insufficient number of reliable refuse vehicles to provide basic refuse services to the citizens of Yakima, and authorizing and directing the City Manager to execute all necessary documents with outside parties to • purchase one replacement refuse vehicle without calling for bids. WHEREAS, Article VI, Section 6 of the Yakima Charter and Chapter 1.80 of the City of Yakima Municipal Code require that the purchase of supplies, materials and services costing more than $25,000.00 be accomplished by a call for bid; and WHEREAS, said Charter provision and YMC Section 1.80.040 allow the City Council to declare an emergency in certain situations and thereby dispense with the need to follow a competitive bid process; and WHEREAS, a Refuse Division Fleet Status Report reveals that the Refuse Division has an insufficient number of reliable refuse vehicles to provide basic refuse services to the community; and WHEREAS, the Refuse Division immediately requires at least one replacement refuse vehicle to correct this situation and the cost of said refuse vehicle will exceed $25,000.00; and WHEREAS, this inability to provide basic refuse services presents a potential hazard to the safety, health, and welfare of the citizens of Yakima; and WHEREAS, the normal bid process for the purchase of a refuse vehicle would take over 90 days, and would prevent the purchase from being completed in a timely manner; and WHEREAS, it is essential to the health, safety, and welfare of the citizens of Yakima that immediate action be taken to purchase a replacement refuse vehicle so that the Refuse Division is able to provide basic refuse services; and WHEREAS, the City Council finds it to be in the best interest of the City to declare an emergency to exist due to the aforementioned conditions and to authorize execution of all necessary documents with outside parties for the purchase of a replacement refuse vehicle without calling for bids, now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: An emergency is hereby declared in that the Refuse Division has an insufficient number of reliable refuse vehicles to provide basic refuse services to the citizens of (1k)res/emer/refuse/jun 00/pm 1 Yakima, and authorizing and directing the City Manager to execute all necessary documents with outside parties to purchase one replacement refuse vehicle without calling for bids. The Refuse Division has recently determined and communicated to City Council that the existing number of vehicles were sufficient to provide service to the current customers and an additional service area known as East Mead. This determination, however, is predicated on the reliability of the current fleet elements. Refuse vehicles experience significant heavy-duty service demands, and the reliability of the current Refuse fleet is not at an acceptable level. One of the first tasks of the Fleet Manager was to evaluate the fleet complement and quality (see attached May 10, 2000 Fleet Status Report). BOARD/COMMISSION/COMMITTEE RECOMMENDATION: COUNCIL ACTION: the last six weeks. This leads to deferred service delivery and excessive overtime to, provide scheduled Refuse pickup. Therefore, because this situation is likely to reappear it has become evident that the average age of the Refuse fleet vehicle needs to shorten; or otherwise stated, the reliability of the current fleet needs to improve. To begin the remedy, it is important that new vehicles begin to replace the older inventory (yet, with no net increase in vehicles necessary.) Staff has received approval from the City Manager to authorize the initiation of the procurement process. This was necessary because a vehicle, which meets our specifications, was available within a short window. The vehicle has now been "reserved" for the City. With the arrival of the above discussed Refuse vehicle and one more, which will arrive this fall (approved through the 2000 Budget process), Refuse will have two new, multipurpose vehicles this fiscal year. Staff will evaluate the need to continue improving the reliability of the Refuse fleet through the 2001 Budget process.
