A RESOLUTION authorizing the City Manager of the City of Yakima to execute a
Memorandum of Understanding between the City of Yakima and
the Yakima Fire Department Battalion Chiefs.
WHEREAS, in 1995 and with City Council approval, the City and the Yakima
Fire Department Battalion Chiefs executed a written Memorandum of Understanding
regarding certain working condition and wage issues; and
WHEREAS, City representatives and the Battalion Chiefs have been involved in
negotiations regarding a new memorandum of understanding; and
WHEREAS, the Battalion Chiefs have agreed to the terms and conditions stated
in the attached Memorandum of Understanding and City representatives recommend
that City Council approve execution of the memorandum of understanding; and
WHEREAS, the City Council has determined that it is in the best interest of the
City of Yakima to enter into said Memorandum of Understanding with the Yakima Fire
Department Battalion Chiefs, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized and directed to execute the attached
and incorporated Memorandum of Understanding with the Yakima Fire Department
Battalion Chiefs.

MEMORANDUM OF UNDERSTANDING
This memorandum of understanding acknowledges and confirms the agreement by and
between the City of Yakima and the Battalion Chiefs of the Yakima Fire Department
regarding compensation and specific employment matters for the Battalion Chiefs.
This memorandum of understanding shall remain in effect for not more than three years
following the effective date of the memorandum. By mutual consent of the parties to the
memorandum, any part or the entire memorandum of understanding may be opened for
cause during the term of the memorandum
The parties agree to the following points having been addressed and clarified regarding
issues, which may or may not be addressed in the Management Compensation Plan.
1. The Battalion Chiefs agree that they shall be a part of, but not limited to the
Management Compensation Plan adopted in Ordinance No. 94-83 effective April
16, 1995.
2. The workweek for "Shift" Battalion Chief shall be 51.38 hours.
3. A Battalion Chief shall be eligible for an additional longevity pay step increase
after 29 years of service to 10% effective April 1, 2000.
4. Battalion Chief promotional standards and, qualifications for Acting Battalion
Chief shall be completed, addressed with the Civil Service Commission, and put
into place no later that June 30, 2000.
5. Battalion Chiefs assigned to Operations will be awarded Vacation time, Kelly
Day time and Holiday time consistent with Department practice for all personnel
assigned to Operations.
6. Complete medical physical exams will be provided at the City's expense at age 40
and every two years thereafter.
7. In an effort to help control the cost of overtime and making no other concessions,
actual or implied, Shift Battalion Chiefs shall be paid at a rate equal to the top -
step straight -time hourly rate for each hour that is worked outside their normal
weekly work schedule to provide coverage of the Shift Commander position in
the absence of the regularly scheduled Shift Battalion Chief due to earned leave
time (Kelly Days, Holidays, vacation, sick/disability leave, administrative leave).
This pay rate shall not apply to emergency callback time (overtime rate of 1 1/2
times the normal rate based on a 40 -hour work -week) or, State Mobilization time
(overtime rate of 1 1/2 times the normal rate based on a 51.38 -hour work -week).
8. The Deputy Chiefs may work outside their normal workweek (40 hours, 8-5, M -F)
to provide coverage of the Shift Commander position in the absence of the regularly
scheduled Shift Battalion Chief and then only on a rotation basis with the Battalion
Chiefs.
9. Only for the purpose of cash outs of earned leave time (vacation, Kelly Days,
Holidays) and/or sick leave time at the time of retirement or termination of
service to the Department, Battalion Chiefs shall receive compensation at an
hourly rate based on their applicable monthly salary divided by 173.33 hours.

ITEM TITLE: Consideration of Legislation needed to reorganize the Fire Department
Command Structure

SUMMARY EXPLANATION:
A proposal by the Fire Department for the re -organization of the Administrative Command
Structure was presented to the Public Safety Committee of the City Council. This proposal is
forwarded to the City Council from the Committee for consideration. The proposal eliminates the
Battalion Chief Training Position and creates a second Deputy Chief position. The
responsibilities of the two Deputy Chiefs would be divided into an Operations/Logistics Deputy
Chief and a Finance/Planning Deputy Chief, following the Incident Management System. The
proposal would also address the overtime for Battalion Chiefs and provide a overall cost/neutral
or cost/savings for the City and update the "Memorandum of Understanding" between the City
of Yakima and the Battalion Chiefs.
The proposal, if accepted, necessitates an Ordinance amending the Municipal Code, a Resolution
Authorizing the Execution of Amendment to the "Memorandum of Understanding" between the
City of Yakima and the Battalion Chiefs and an Ordinance amending the Municipal Code,
1.18.040 Fire Department, concerning Deputy Chief duties.
