R-2000- 4 5 A RESOLUTION authorizing the City Manager to execute and file a funding assistance application for a Washington Wildlife and Recreation Program .application ,project to the Interagency Committee for Outdoor Recreation ("IAC") as provided in Chapter 79A.15 RCW, Acquisition of Habitat. Conservation and Outdoor Recreation Lands and all other applications, agreements, amendments and documents for the purpose of acquiring land to expand Kiwanis Park. WHEREAS, the City Council of the City of Yakima has approved a comprehensive plan that includes this project area; and WHEREAS, under the provisions of the WWRP, state and federal funding assistance is requested to aid in financing the cost of land acquisition; and WHEREAS, the City Council of the City of Yakima considers it in the best public interest to acquire land to expand Kiwanis Park to complete the acquisition project described in the funding assistance application; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: 1. That the City Manager of the City of Yakima is hereby authorized to execute and file an formal application with the IAC for funding assistance; and 2. That any fund assistance received be used for the implementation of the project referenced above; and 3. That the City of Yakima certifies that its share of project funding is committed and will be derived from a land donation by the Yakima Rotary Trust; and 4. That the City of Yakima acknowledges that it is responsible for supporting all non-cash commitments to the sponsor share should they not materialize; and 5. That the City of Yakima acknowledges that any property acquired with IAC financial aid must be placed in use as an outdoor recreation area and be retained in such use in perpetuity unless otherwise provided and agreed to by our organization, IAC and any affected federal agency; and 6. Ai 1 EST: Place, Mayor G ,,c_ City Clerk (Ik)res/parks kiwams park land 00 -pm Letter of Understanding Yakima Rotary trust/City of Yakima March 21, 2001 This document is intended as a verification of the current understanding between the City of Yakima (City) and the Yakima Rotary Trust (YRT) regarding the pursuit of a Big League Dreams (BLD) facility at the expanded Kiwanis Park site. The Yakima Rotary Trust is acting as the funding authority for several service clubs and private groups whom have been working on this project. As such, YRT has been asked by the City to fund both an economic impact study and an engineering study to verify market feasibility and the estimated construction costs. Preliminary proposals have indicated the costs of these two studies to be between $35,000 and $40,000. With this request in mind, YRT would like to verify the following: 1. YRT will proceed with obtaining an economic impact study and an engineering study on the Kiwanis Park Big League Dreams project. The information gathered will be made available to the City for analysis and review. The City Council will be presented with this data in their deliberations on this project. The cost for these studies may be reimbursable to YRT with City Council approval if funds become available through voter approval of the financing package required to build the Big League Dreams project. 2. The City is willing to proceed with further discussions with BLD and upon Council's approval, would negotiate a future agreement with BLD. However, any added consulting fees desired and payable to BLD would be subject to mutual agreement between the parties and conditioned upon City Council approval and voter approval of the financing plan for this project. 3. This project and the associated funding package will be presented in a City Council Study Session currently scheduled for April 17, 2001. At this time, City staff will present recommendations to the City Council for review and consideration. If approved or amended, the recommendations would then be brought before Council in formal session for action. Following formal direction and approval from Council on the recommendations, staff will work with YRT to have this issue referred to the voters in a September Special Election or a date mutually agreed upon. The promotion campaign will be led by the Kiwanis Park Expansion Steering Committee to be identified at a later date. The Rotary Trust Board has unanimously agreed to pursue this opportunity for the citizens of Yakima and for Yakima's future. The provisions outlined above provide the understanding needed so that YRT can proceed in preparing their information for the April 17th Council Study Session.
