R-2000-027 Quit Claim Deed for YVT property exchange with Washington State Department of Transportation (DOT) near Selah
RESOLUTION NO. R-2000- 27 A RESOLUTION relating to real property owned by the City of Yakima which was possessed and used by the state Department of Transportation during the Selah Interchange Project. WHEREAS, in conjunction with the Selah Interchange Project, recently constructed by the State Department of Transportation, it was agreed between the City of Yakima and the State that the State would convey certain State-owned real property to the City of Yakima in exchange for and to replace certain City -owned property which the State required as right of way for the Interchange Project; and WHEREAS, the Selah Interchange Project has been successfully completed; and WHEREAS, the State Department of Transportation has prepared deeds to be exchanged by the City and the State to accomplish the parties' agreement ; and WHEREAS, it is in the best interest of the City to complete the agreed exchange; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is authorized to execute the attached Quit Claim Deed to complete the exchange of City- and State-owned properties according to agreements established between the City of Yakima and the State Department of Transportation in conjunction with the Selah Interchange Project. It is also understood and agreed that the grantee, its successors or assigns, shall not revise either the right of way lines or the access control without prior written approval from the grantor, its successors or assigns. Revenues resulting from any vacation, sale, or rental of this property, or any portion thereof, shall: (1) if the property is disposed of to a governmental entity for public use, be placed in the grantee's road/street fund and used exclusively for road/street purposes; or (2) if the property is disposed of other than as provided in (1) above, be shared by the grantee and grantor, their successors or assigns in the same proportion as acquisition costs were shared, except that the grantee may deduct the documented directs costs of any such vacation, sale, or rental. EXCEPT that said Grantee, its successors or assigns, shall have reasonable ingress and egress, to, from, and between the lands herein conveyed and said Highway via grade intersections thereto and at those points and under those conditions allowed by access notes and approach schedule, all as shown or noted on said Exhibit "A".
