ITEM TITLE: Ordinance amending Chapter 7.68 of the Yakima Municipal Code
(YMC) regarding Water Rates and Charges

SUMMARY EXPLANATION:
The City is authorized by Title 35 RCW to acquire, construct, own, operate, and provide financing
for waterworks and systems of sewerage, and to establish rates, fees, and charges for that
service. In accord with that authority, the City assesses water distribution, storage and treatment
rates and charges as established in §7.68 of the YMC.
To maintain pace with all the regulatory compliance issues identified over the next ten years, water
rates need to be increased. Should rates not be increased, the only alternative would be to
significantly increase the Division's debt service; reducing its available cash and cash transfers in
order to meet regulatory mandates.
In order to provide an unbiased comprehensive analysis of the Water Division's financial needs,
the City contracted with FCS Group to conduct a rate study over a five-year period (2013-
2017). Such services provide the City with an independent, objective in-depth look as to what
proper funding levels are really required to ensure the citizens of Yakima with water services now,
and in the future; while remaining compliant with all of the federal and state rules and regulations.
After this third party review, FCS Group proposed an annual rate increase of approximately 4%
over five years to provide the Water Division with proper funding levels. Those increases did not
occur. The proposed ordinance adjusts the rate for an increase of 8.5% in 2017 and 2018. This
rate increase will fund mid -horizon (3 to 7 years) capital projects for maintaining adequate
treatment capacity and responsible ongoing replacement of aging infrastructure.

AN ORDINANCE establishing rates, charges, terms and conditions for domestic water
system connections and service; amending sections 7.68.250, 7.68.251
and 7.68.282 of chapter 7.68, Water Division, of the City of Yakima
Municipal Code; and providing for an effective date.
WHEREAS, RCW 35.92.010 authorizes cities to own and operate water utilities, and to
regulate and control the use, distribution, and price for water utility service; and
WHEREAS, Article IX, Section 1 of the City Charter of the City of Yakima authorizes the
City Council to provide by ordinance rules and regulations for the control, management and
operation of all public utilities owned and operated by the City; and
WHEREAS, the City Council has established rates and charges for domestic water
connection and service through the enactment of Yakima Municipal Code (YMC) chapters 7.68
and 7.75; and
WHEREAS, the City Council finds and determines that the rates, charges, terms and
conditions for domestic water utility service set forth in this ordinance are fair, just and
reasonable; and
WHEREAS, the City Council finds and determines that adoption of this ordinance is in
the public interest; now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 7.68.250 of the City of Yakima Municipal Code is hereby amended to
read as follows:

GB. The ready -to -serve charge may be computed on a daily basis by dividing the two
month charge by 60 days.
C. All charges for water supplied outside the city shall be computed by multiplying the
applicable rates set forth in subsections A through 4 B of this section by one and one-half
GD. Home Kidney Dialysis. A residential customer who undergoes kidney dialysis at his or her
home, or whose home is also the home of a different person who undergoes home kidney
dialysis, shall not be required to pay utility charges for domestic water service or sewer service
for the quantity of water that is necessary for the home dialysis. In order to be excused from
utility charges under this subsection, the residential customer must present to the director of
finance and budget or their designee written documentation annually from a recognized kidney
dialysis center certifying that the person requires dialysis and the quantity of water needed for
that person's dialysis.
Section 2. Section 7.68.251 of the City of Yakima Municipal Code is hereby amended to
read as follows:
7.68.251 Bulk rate.

A GOMMeR,� February , the charge for water supplied through fire hydrants, when
the water is used by either the city or a private person for any use authorized by the
water/irrigation division, shall be the same as the highest UOC charge set forth in YMC
7.68.250. No charge shall be made for water supplied through fire hydrants when the water is
used for fire suppression or for maintenance and operation purposes by the city.
B. All water served through a fire hydrant shall comply with YMC 7.68.300.
C. Daily meter assembly use charge for temporary water service shall be four dollars for each

Section 3. Section 7.68.282 of the City of Yakima Municipal Code is hereby amended to

B. Daily charge is calculated by dividing the bimonthly charge by sixty days.
C. Charges for fire services outside the city limits shall be computed by multiplying the
applicable rate above by one and one-half.
D. The inside diameter of the pipe leading to a fire hydrant shall determine the service charge.
Any fire hydrant installed and maintained by the city outside of city limits will be billed as a fire
service, which charge shall be terminated at such time as the responsible consumer's property
is annexed to the city.
Section 4. Severability. If any section, sentence, clause or phrase of this Ordinance should
be held to be unconstitutional, unlawful or invalid by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section,
sentence, clause or phrase of this Ordinance.
Section 5. Effective Date. This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter.
