A RESOLUTION" declaring an emergency and authorizing the City Clerk and the City Manager to
execute all necessary documents with outside parties for the repair and/or
replacement of a sewer line without calling for bids.
WHEREAS, Article VI, Section 6 of the Yakima Charter and Chapter 1.80 of the City of Yakima
Municipal Code require that the purchase of supplies, materials and services costing more than
$25,000.00 to be accomplished by a call for bid; and
WHEREAS, said Charter provision, YMC Section 1.80.040 and RCW 35.22.620(6) allow the
City Council to declare an emergency in certain situations and thereby dispense with the need to follow a
competitive bid process; and
WHEREAS, an inspection of a sewer line within the City of Yakima in the vicinity of Tieton
Drive and 28th Avenue reveals that the line is structurally damaged and must be repaired or replaced; and,
WHEREAS, the location of the sewer line at issue is shown on attached and incorporated Exhibit
"A"; and
WHEREAS, the damaged sewer line presents a potential hazard to the safety, health, and welfare
of the citizens of Yakima; and
WHEREAS, the costs of the repairing and/or replacing will exceed $25,000.00; and
WHEREAS, the normal bid process for the repair and/or replacement work would take over 90
days, and would prevent the necessary repairs and/or replacement from being completed in a timely
manner; and
WHEREAS, it is essential to the health, safety, and welfare of the citizens of Yakima that
immediate action be taken to repair and/or replace the sewer line; and
WHEREAS, the City Council finds it to be in the best interest of the City to declare an emergency
to exist due to the aforementioned conditions and to authorize execution of all necessary documents with
outside parties for the repair and/or replacement of the sewer line without calling for bids; now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
An emergencyis hereby declared regarding the current status of the sewer line shown on Exhibit
"A" and the City Clerk and City Manager are hereby authorized and directed to execute all necessary
documents with outside parties for the repair and/or replacement of the sewer line without calling for bids.
ADOPTED BY THE CITY COUNCIL this 7th day of September, 1999.

SUMMARY EXPLANATION: Inspection of a sewer line, within the City of Yakima, in the vicinity of Tieton
Drive and 28th Avenue reveals that the line isstructurally damaged and must be repaired or replaced;
as the damaged sewer line presents a potential hazard to the safety, health, and welfare of the
citizens of Yakima.
The normal bid process for the repair and/or replacement work would take over 90 days, and would
prevent the necessary repairs and/or replacement from being completed in a timely manner.

REGARDING GENERAL AGREEMENT BETWEEN CITY OF YAKIMA
AND
HUIBREGTSE, LOUMAN ASSOCIATES, INC.
SCOPE OF SERVICES
Municipal Engineering Services
The ENGINEER shall provide professional engineering services necessary for the emergency
rehabilitation of an existing 8 -inch diameter sanitary sewer collection pipe located across property
and under a house near 28th Avenue and Tieton Drive. Such services shall include the following:
1. Evaluate alternative methods of rehabilitation of the referenced sanitary sewer
pipeline.
2. Develop abbreviated plans and specifications to solicit bids from construction
contractors under emergency conditions declared by the Yakima City Council.
3. Solicit, receive, and evaluate construction contractor bids received for such sanitary
sewer rehabilitation.
4. Recommend construction contract award.
5. Provide construction contract administrative services.
6. Provide a resident engineer to observe construction activities for compliance with
the plans and specifications.
7. Recommend progress pay estimates for the construction contractor.
8. Prepare record drawings of the completed construction work.
TIME OF PERFORMANCE
Huibregtse Louman Associates, Inc., will diligently pursue timely completion of assigned work. All
services will be completed within a time mutually agreed upon by the CITY and the ENGINEER.

All work shall be performed on a time spent basis at the normal hourly billing rates included in our
General Agreement plus reimbursement for subconsultant, travel, and reproduction costs, up to
