A RESOLUTION authorizing the City Manager to execute a Quit Claim Deed releasing
unused public utility easements.
WHEREAS, on September 24,1984, the City of Yakima acquired two 8 -foot -wide utility
easements (referred to below as the "Subject Easements") over real property legally described
as:
The North 8 feet of and the East 8 feet of the East 25 feet of Lot 1 of Short Plat No. 84-
202, recorded under Yakima County Auditor's File #2715832;
WHEREAS, the subject property was enlarged via Survey Book 40 Page 34, recorded May 5,
1986, Assessor's File No. 2762648; and
WHEREAS, the Yakima Valley Credit Union owns the property burdened by the Subject
Easements; and
WHEREAS, the City makes no current use of, nor does it have any plans or need to use the
Subject Easements in the future; and
WHEREAS, the Yakima Valley Credit Union has requested that the City release the Subject
Easements; and
WHEREAS, on May 13, 1999, after proper public notice, a duly convened public hearing
regarding the Yakima Valley Credit Union's request that the City release the Subject
Easements was held by the Hearing Examiner in full compliance with the procedures as set
forth in RCW 58.17.212; and
WHEREAS, on July 1, 1999, the Hearing Examiner issued Examiner's Decision IU99-4-10, by
which the Yakima Valley Credit Union's request that the City release the Subject Easements
was approved; and
WHEREAS, the City Council deems it to be in the best interest of the City that the easements
described above be released now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is authorized and directed to execute the attached "Quit Claim Deed," in
favor of the Yakima Valley Credit Union to release the City's interest in the easements for the
purpose of installing and maintaining an irrigation waterline, which were established by Short
Plat No. 84-202 and which were recorded underakima County Auditor's File No. 2715832.

The applicant applied for the release of a public utility
easement. A hearing was held May 13, 1999. The Hearing
Examiner visited the site on May 13, 1999.
SUMMARY OF DECISION: The application for release of the utility
easement is APPROVED.
Based on the site visit and a review of the evidence received at
hearing, the staff report, and applicable statutes and
ordinances, the Examiner makes the following
FINDINGS.
1. APPLICANT: Yakima Valley Credit Union
2. LOCATION: 5012 Summitview Avenue
3. LEGAL DESCRIPTION: North 8 feet and the East 8 feet of the
East 25 feet of Lot 1 of Short Plat No. 84-202, recorded under
Yakima County Auditor's File No. 2715832.
4. BACKGROUND: In 1984, five lots on the southwest side of
the intersection of Summitview Avenue with 50th Avenue were
established by a short plat. The short plat included an 8 foot
utility easement on the north and east sides of Lot 1. In 1986,
a short plat added several feet to the western, southern and
eastern property lines to parcel #18132-41005. This addition
resulted in placing the utility easement 17 feet to the east of
the new western property line, with a 25 feet length utility
easement located along the north property line parallel with

Summitview Ave. Utility easements located on lots Two, Three and
Five created by the 1984 short plat were removed during
development approval process in 1992 for the Chestnut
Subdivision. No utilities have been installed in the subject
easement. There is no present or future intention to use the
subject utility easement for utility purposes.
In 1990, the Yakima Valley Credit Union received zoning
approval for parcel 18132-41005. In 1992, the Yakima Valley
Credit Union received approval for a second zoning review. A
residential structure was moved from the property on June 30,
1992. Building permits were issued for the construction of the
credit union facilities. The City approved the construction of
the drive-through lanes over the utility easement, based in part
on release statements received by the Planning Division from the
following: City of Yakima Engineering Division, Yakima Health
District, Yakima Waste Systems, TCI of Yakima, Cascade Natural
Gas Corporation, US West Communications, Pacific Power, and Nob
Hill Water Association. However, no plat amendment releasing
the easement was processed, although one was applied for.
5. ZONING AND LAND USE: The site is zoned B-1, Professional
Business, and contains the Yakima Valley Credit Union office.
Financial Institutions are a Class 2 use in B- 1 zoning.

6. PUBLIC NOTICE: Notice was ,issued in accordance with
applicable ordinances.
Based on the foregoi'ngtfi-ndings, the Examiner makes the
following
CONCLUSIONS.
1. The Hearing Examiner has jurisdiction to conduct
hearings and render final decisions on plat amendments pursuant
to RCW 58.17.217 and YMC 1.43.080(d). The subject easement was
dedicated in the course of approving Short Plat No. 84-202.
Release of the easement constitutes amendment of the plat.
Therefore, the Hearing Examiner has jurisdiction to render a
decision on the easement release application.
2. In considering an application for an amendment that
releases a dedicated easement, the decision standard is the
consistency of the amendment with the public use and interest.
Based on the releases and authorizations of use from utility
service providers, there is no present or future intended use of
the easement for utility purposes. In addition, the utility
easement to be released is limited to the platted property owned
by the applicant and does not extend to property owned by
others. Further, the existing development was authorized in
accordance with zoning and building code requirements.
Accordingly, the release does not present a conflict with the
public interest.
3. The application for the release of the utility
easement does not constitute a request for the release of any
other easement which may°have been dedicated or otherwise
created over the described property. Accordingly, approval of
the release of the utility easement does not constitute the
approval of the release any other easement.

SUMMARY EXPLANATION:
The Yakima Valley Credit Union is requesting the release of an existing 8 -foot wide
public utility easement, created by Short Plat No. 84-202, recorded under Auditor's File
No. 2715832 on the subject property located at 5012 Summitview Avenue. Credit union
facilities, constructed on the subject property in 1992, cover a portion of the platted
utility easement. Through additions to the subject property recorded in Survey Book 40
Page 34 of the records of Yakima County, and the location of the credit union facilities,
the platted utility easement no longer serves the purpose for which it was originally
established.
On May 13, 1999, the Hearing Examiner conducted a public hearing to consider this
request and following the hearing recommended approval with no conditions of
approval.
On August 17, 1999, City Council approved the release of the easement and directed
the Legal Division to prepare the appropriate legislation.
