Home My WebLink AboutR-1999-094 Quit Claim DeedRESOLUTION NO R-99-94 A RESOLUTION authorizing the City Manager and the City Clerk of Yakima to execute a Quit Claim Deed releasing an unused irrigation waterline easement. WHEREAS, On January 30 and 31, 1923, the City of Yakima acquired two contiguous 20 foot -wide easements crossing the Northeast 1/4 of the Northwest 1/4 of the Northeast 1/4 of Section 24, Township 13 North, Range 18 E.W.M. These easements were for the purpose of installing and maintaining an irrigation waterline, and were recorded under Yakima County Auditor's File Nos. 281772 and 281773; and WHEREAS, the Yakima Housing Authority (YHA) owns the property burdened by the easements described above; and WHEREAS, the YHA property is the site of a YHA housing development project known as Mariposa Park, which required relocation of the irrigation waterline which was installed in the easements described above; and WHEREAS, YHA has relocated the irrigation water line and has conveyed a new easement to the City for the relocated irrigation water line; and WHEREAS, YHA has requested that the City release the easements described above; and WHEREAS, the relocated irrigation water line constructed by YHA and the new easements conveyed to the City by YHA eliminate any need for the easements described above ; and WHEREAS, the City Council deems it to be in the best interest of the City that the easements described above be released now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is authorized and directed to execute the attached "Quit Claim Deed," in favor of the Yakima Housing Authority to release the City's interest in the easements for the purpose of installing and maintaining an irrigation waterline, which were recorded under Yakima County Auditor's File Nos. 281772 and 281773. Cook, Director of Community Economic Development CONTACT PERSON / TELEPHONE: Bruce Benson, Associate Planner, 575-6042 SUMMARY EXPLANATION: In January of 1923, the City of Yakima acquired two contiguous 20 foot wide easements for the purpose of constructing and maintaining an irrigation pipeline. Today the Yakima Housing Authority has purchased the land subject to these easements and is nearing completion of their Mariposa Park housing development. During the construction of Mariposa Park the old irrigation lines were replaced and relocated into a new easement thereby rendering the old easements unnecessary. The Housing Authority has requested that these unused easements be released so that storage structures for the housing development can be built where the old easements ran. The Water and Irrigation Department has fully reviewed this matter and concurs with the request for release of the easements. Because these easements were originally created by an easement deed they can be effectively and economically released by a Quit Claim Deed.
