A RESOLUTION authorizing and directing the City Manager of the City of Yakima to
execute a license agreement with the Department of the to utilize a
firing range at the Yakima Training Center.
WHEREAS, the Yakima Police Department utilizes firing range facilities at the
Yakima Training Center by virtue of a license granted by the Department of the Army,
which license has expired and must be renewed to allow continued use by the Yakima
Police Department of those firing range facilities; and
WHEREAS, the Department of the Army has offered to renew and extend such
license according to the terms and conditions of the license agreement document attached
hereto; and
WHEREAS, the City Council deems it to be in the best interests of the City that such
license agreement be executed, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager of the City of Yakima is hereby authorized and directed to
execute a license agreement with the Department of the Army for the above purpose, a copy
of which license agreement, identified as Department of the Army License No. DACA67-3-
94-145 Yakima Training Center, Yakima County, Washington, is attached hereto and by
reference made a part hereof.

SUPPLEMENTAL AGREEMENT NO. 1
LICENSE NO. DACA67-3-94-145
YAKIMA TRAINING CENTER, WASHINGTON
WHEREAS, DEPARTMENT OF THE ARMY License No. DACA67-3-94-145
granted the CITY OF YAKIMA, WASHINGTON; POLICE DEPARTMENT a license for
the use of Tank Range No. 3, commencing on 1 February 1994 and ending 31 January
1999; and,
WHEREAS, the grantee has requested that said license be extended for an
additional term beyond the current expiration date; and,
WHEREAS, the Department of the Army has determined that the name of the
installation has been changed; and,
WHEREAS, the Department of the Army has determined that Condition No. 12
Non -Discrimination be deleted and replaced by a new Condition No. 12; and,
WHEREAS, the Department of the Army has determined that it is in the best
interest of the Government to amend said license.
NOW, THEREFORE, said License No. DACA67-3-94-145 is hereby amended in
the following particulars:
1. The license is amended to delete all references to Yakima Firing Center and
to replace all references with Yakima Training Center.
2. Condition No. 12 Non -Discrimination is hereby deleted and replaced with
the following:
"The grantee shall not discriminate against any person or persons or exclude
them from participation in the grantee's operations, programs or activities because of
race, color, religion, sex, age, handicap or national origin in the conduct of operations
on the premises. The grantee will comply with the Americans with Disabilities Act and
attendant Americans with Disabilities Act Accessibility Guidelines (ADAAG) published
by the Architectural and Transportation Barriers Compliance Board".
3. The telinination date is extended an additional five (5) years through 31
January 2004.
ALL OTHER TERMS AND CONDITIONS SHALL REMAIN THE SAME.
IN WITNESS WHEREOF, I have hereunto set my hand by authority of the
Secretary of the Army on this 5ria day of MAY , 1999.

SUMMARY EXPLANATION:
The attached agreement for License No. DACA67-3-94-145 is a renewal of an agreement
that has been in existence in excess of 25 years, allowing the Yakima Police Department
to utilize the Yakima Firing Range for weapons training.
This renewal agreement extends the termination date through January 31, 2004 and is at
no cost to the City of Yakima.
