R-99- 35 A RESOLUTION authorizing the Yakima Fire Department to purchase Personal Alert Safety System (PASS) devices with funds approved in the 1999 Fire Department Capital Budget. WHEREAS, the Yakima Fire Department is required by industry standard and Washington State law to provide PASS devices as a safety element of the Fire Fighter personal protective ensemble; WHEREAS, the existing PASS devices of the Yakima Fire Department are well beyond their service life expectancy, failing far too frequently, expensive to repair, and not in compliance with updated industry standards and requirements of State Law; WHEREAS, the new PASS device becomes an integral part of our current MSA brand of self-contained breathing apparatus (SCBA); WHEREAS, SeaWestern, Incorporated of Kirkland, Washington is the sole authorized and designated supplier of MSA products for the Yakima Fire Department and therefore a "sole source provider;" WHEREAS, due to the necessity to comply with updated industry standards and Washington State Law, no realistic or viable alternatives exist; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: 1. The Yakima Fire Department is authorized to purchase the required Personal Alert Safety System devices. 2. The purchase of the Personal Alert Safety System devices shall not exceed the approved Fire Capital Budget amount of $38, 844. ADOPTED BY THE CITY COUNCIL this 6th day of April, 1999. Gillespie, Fire Chi CONTACT PERSON/TELEPHONE: Joe May, Battalion Chief - 576-6351 SUMMARY EXPLANATION: This request is for approval to purchase the Personal Alert Safety System (PASS) devices. The money ($38,844) for this purchase was appropriated and approved in the budget process for the 1999 Fire Department Budget. These devices are a required safety element of the Fire Fighter's protective ensemble. Our existing devices are well beyond their service life expectancy, failing far too frequently, expensive to repair, and not in compliance with updated industry standards and requirements of State law. Due to the necessity of compliance with industry standards and Washington State Law, realistic viable alternatives are non-existent. The new PASS device is to become a part of our current MSA brand self-contained breathing (SCBA) apparatus. Therefore, we can use only the MSA brand of PASS device, a patented component of the SCBA system. For that reason, we must purchase the PASS devices from the same company where we purchase the MSA brand of SCBA, or, a "single source provider." Other brands are neither compatible nor interchangeable. The company that is the sole authorized and designated supplier of MSA products (see enclosed letter), including SCBA's and parts to the Yakima Fire Department is SeaWestern, Incorporated of Kirkland, Washington. We need to move forward as soon as possible with the purchase of these devices. We request approval to immediately order and receive the necessary PASS devices from this single source provider to complete the required update of this safety element of the Fire Fighter personal protective ensemble. MSA establishes distributors to sell, service and promote MSA products according to a prepared MSA business/market plan. Authorized distributors are•aasigned a business maricet within an assigned geographical area. The MSA business plan provides MSA customers with the assurance that authorized distributors will provide them with proper equipment selection, =Wing and repair service. MSA products sold through authorized MSA distributors are backed by MBA warranties. MSA does not and will not restrict a distributor from selling MSA products outside their assigned market or geographical area or establish a selling price. However, sales outside an authorized distributor's market and geographical area ere not in accordance with a distributor's Business Agreement agreed to by the distributor and MSA. Should an authorized MSA distributor sell MSA products outside their assigned market and/or geographical area, by terms of the distributor's Agreement, MSA reserves tba right to refuse to honor any purchase order for MSA products by the distributor with ultimate delivery into an area where, in MSA's opinion, the distributor does not have the capability to properly servioe MSA customers on products or train the customer in product use. The distributor may also be considered for immediate termination as an authorized MSA distributor.
