A RESOLUTION authorizing and directing the City Manager of the City of Yakima to
execute a "Modification No. 2 to Dial -A -Ride Transportation
Service/Broker and/or Provider Agreement" with Access Paratransit, Inc.
WHEREAS, on November 13, 1996, the City and Access Paratransit entered into Dial -A -
Ride Transportation Service/Broker and/or Provider Agreement for provision of paratransit
services; and
WHEREAS, on November 7, 1997, and pursuant to City Council authorization, the City
and Access Paratransit executed Modification No. 1 that increased the service fee for non -lift
equipped boardings from $6.50 to $9.00 per boarding, and the service fee for lift equipped
boardings from $10.00 to $12.55 per boarding; and
WHEREAS, the City and Access Paratransit desire to further modify the Agreement to
increase said service fees by $.28 to reflect recent minimum wage law changes and to add an
"escalator" clause regarding service fees; and
WHEREAS, the City Council has determined that it is in the best interest of the City to
authorize the City Manager to execute "Modification No. 2 to Dial -A -Ride Transportation
Service/Broker and/or Provider Agreement" in order increase service fees to reflect minimum
wage law changes, to add an "escalator" clause regarding service fees, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized and directed to execute the attached and
incorporated "Modification No. 2 to Dial -A -Ride Transportation Service/Broker and/or
Provider Agreement" with Access Paratransit, Inc.

MODIFICATION NO. 2 TO
DIAL -A -RIDE TRANSPORTATION
SERVICE BROKER AND/OR PROVIDER
AGREEMENT
THIS MODIFICATION (hereinafter "Modification No. 2") to the existing Dial -A -Ride
Transportation Service Broker and/or Provider Agreement (hereinafter "Agreement") is
entered into by and between the City of Yakima, Washington, a municipal corporation,
(hereinafter the "City"), and Access Paratransit, Inc., a Washington corporation,
hereinafter "Access Paratransit".
WHEREAS, on November 13, 1996, the City and Access Paratransit entered into
the Agreement for provision of paratransit services; and
WHEREAS, on November 7, 1997, and pursuant to City Council authorization,
the City and Access Paratransit executed Modification No. 1 that increased the service
fee for non -lift equipped boardings from $6.50 to $9.00 per boarding, and the service fee
for lift equipped boardings from $10.00 to $12.55 per boarding; and
WHEREAS, the City and Access Paratransit desire to further modify the
Agreement to increase said service fees by $.28 to reflect recent minimum wage law
changes and to add an "escalator" clause regarding service fees.
NOW, THEREFORE, the City and Access Paratransit agree to the following underscored
modifications to Section 10, "Payment" of the Agreement:
10. Payment. The City agrees to pay the Contractor a fee for services
calculated and invoiced as follows:
A. On a monthly basis ridership, by boardings requiring a
wheelchair lift equipped vehicle and boardings not requiring a lift
equipped vehicle. The City shall pay Contractor $10.00 12.83 per
boarding for boardings requiring a wheelchair lift equipped
vehicle, and $6,50 9.28 per boarding for boardings not requiring a
wheelchair lift equipped vehicle.
B. The appropriate fare per passenger shall be collected and
reported.
C. An invoice shall be prepared and presented to the City
which presents the above information as a net billing. Thus, fares
collected shall be retained by the Contracting Agency and
deducted from the fees for service amount.
D. Effective March 1, 1999, and January 1 of each succeedin
year during the term of this Agreement, the service fees referred
to in subsection (A) of this Section shall be increased by the a
percentage change equal to the average of the U.S. Cities
Consumer Price Index (CPI -W) and the Seattle Consumer Price
Index for wage earners calculated for the twelve month period
ending on Tune 31 of the preceding year. The reference base
period for said Seattle CPI is 1982-84 = 100. If the percentage
change in said Indexes does not result in an increase, the service
fees shall not change.
The modification ($.28 increase) of services fees in Section (10) (A) that reflects minimum
wage law changes shall be effective and retroactive to January 1, 1999.
Except to the extent expressly modified herein, all of the other terms and conditions
contained in the Agreement and Modification No. 1 shall remain in full force and effect.
THIS MODIFICATION is executed by the parties this ' 6 day of March, 1999.

Agreement with Access Paratransit

SUMMARY EXPLANATION: On March 2, 1999, the request for modification of the
Dial -A -Ride contract came before City Council. The request was as follows: 1.) an
increase of $.28 per boarding in the rate of compensation to be retroactive from
1/1/99, and 2.) an annual rate increase tied to the Consumer Price Index (CPI),
which will allow the contractor to recover from the impact of mandated minimum
wage increases over the remaining life of the contract (through November of
2001). Following considerable discussion, the issue was referred to the Council
Transit Committee for further review and recommendation.
Transit Committee members Henry Beauchamp and John Klingele met on March 10,
1999, to discuss the issue and develop a recommendation to Council. It is
recommended that the contract modifications be approved with the exception of
the index being used to determine the annual rate increase. It is recommended that
the CPI for all Westem Consumers be replaced with a blended CPI which averages
the CPI for Seattle Wage Earners and the CPI for Westem City Consumers (CPI -W).

To approximate the impact of these changes, if the CPI is figured at 2.2% (as
recommended by the Transit Committee), and applied to the rates as modified in 1.)
above (an additional $.28/boarding), it will add another $.20 more to the
ambulatory rate and $.28 more to the non ambulatory rate. The combined impact of
the proposed changes brings the ambulatory rate to $9.48 and the non ambulatory
rate to $13.11 per boarding. The total increase in contract cost is estimated at
$33,410 for 1999, assuming no change in ridership from '98 levels. There should
be sufficient leeway in the budget (currently set at $715,000) to absorb the
increase.

SUBJECT: Dial -A -Ride Contract Modification
At the last City Council meeting (3/2/99), amendments to the contract with
Access Paratransit for Dial -A -Ride service were proposed for Council
consideration. The item was tabled as questions arose as to the use of automatic
escalation clauses in purchase of service contracts and whether Access
Paratransit is licensed to charge DAR clients for service outside City boundaries.
The Consumer Price Index (CPI) is used in most of the City's labor contracts to
annually determine the amount of cost of living wage increases. An average of
two, the CPI for Western Cities (CPI -W) and the Seattle CPI for Wage Earners,
is used in all cases. Currently 100% of this average is being used in those labor
contracts which contain such provisions. Labor contracts usually set minimum
and maximum percentages. CPI -W was 1.6% at year end '98; Seattle CPI for
Wage Earners was 2.8% at year end '98. The average of the two is 2.2% for year
end 1998.
In the purchase of goods and services, the City occasionally uses similar
automatic escalation clauses. Currently the Purchasing Division has at least
two service contracts which utilize the CPI for All Western Consumers which
was at 2.7% at the end of 1998.
Access Paratransit has a Limousine License issued by the Washington State
Utilities and Transportation Commission which allows them to charge
passengers for services outside their contract with the City of Yakima.
