A RESOLUTION authorizing and directing the City Manager of the City of
Yakima to execute a revised Supplemental Police Services
Agreement with the Yakima Housing Authority to provide
additional police services to help create a drug- and crime -free
environment and to provide for the safety and protection of
the residents in its public housing developments.
WHEREAS, the Yakima Housing Authority desires to contract with the
City for additional police services to help create a drug- and crime -free
environment and to provide for the safety and protection of the residents in its
public housing developments; and
WHEREAS, the City, by and through its police department, is willing to
provide such police services to the Yakima Housing Authority; and
WHEREAS, on August 18, 1998, the City Council authorized execution of
a "Supplemental Police Services Agreement" with the Yakima Housing
Authority in order to provide said police services; and
WHEREAS, the Agreement will expire on December 31, 1998 and not all
of the requested police services will have been performed; and
WHEREAS, the City and the Yakima Housing Authority desire to revise
and extend the term of, the Agreement through August 31, 1999 in order to
permit sufficient time for the performance of the desired police services; and
WHEREAS, the City Council deems it to be in the best interest of the City
of Yakima to authorize revision of the Supplemental Police Services Agreement
to extend the term of the Agreement to August 31, 1999 in order to permit
sufficient time for the performance of the desired police services with the Yakima
Housing Authority; now, therefore,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
The City Manager of the City of Yakima is hereby authorized and directed
to execute the attached, revised and incorporated Supplemental Police Services
Agreement with the Yakima Housing Authority to help create a drug- and
crime -free environment and to provide for the safety and protection of the
residents in its public housing developments.

SUPPLEMENTAL POLICE SERVICES AGREEMENT
This Supplemental Police Services Agreement (hereinafter the "Agreement") is made
and entered into by and between the Yakima Housing Authority, (hereinafter the "Authority")
and the City of Yakima, (hereinafter the "City").
WHEREAS, the Authority desires to contract with the City for additional police services
to create a drug- and crime -free environment and to provide for the safety and protection of the
residents in its public housing developments; and
WHEREAS, the City, by and through its police department, desires to assist in the effort
by providing effective police services at all Authority locations;
NOW, THEREFORE, in consideration of the mutual covenants, promises, and
agreements set forth herein, it is agreed by and between the City and the Authority as follows:
1. Scope of Services. The City agrees that the services rendered by police
personnel under this Agreement are in addition to baseline police services. The City agrees that
it will not reduce its current level of police services to the public housing developments,
particularly in the areas of community policing, patrol, criminal investigations, records,
dispatch and special operations; provided, however, that the provision of services under this
Agreement is conditioned upon a sufficient number of City police personnel being available.
The duties and extent of services of the Assigned Personnel may include, but are not
limited to the following:
a. Meet with residents of Yakima's low income housing units, and facilitate crime
prevention, safety, and general crime awareness training to the residents.
b. Work with the Yakima Housing Authority to deter drug related activities in and
around the housing units.
c. Educate residents in neighborhood crime prevention, and establish a cooperative
effort on the part of the residents to report criminal activities.
d. Educate residents in areas of burglary prevention, with presentations, security
surveys, and educational materials. In this effort, engraving and operation
identification may be used.
e. Provide approximately 162 hours of law enforcement crime prevention services
above and beyond baseline services, for a contractual service amount of $6,000.
This crime prevention program will occur between April 1, 1998 and August 31,
1999, and may include the following specific activities:

i. Tour units to determine layout, and any special needs. Attend meetings
with housing authority staff to discuss plans and goals.
ii. Provide on site visitation. These visits are intended to "break the ice"
with residents and would include visits by McGruff The Dog (a Crime
Prevention Mascot), and high profile visits by Yakima Police Department
at YHA complexes.
iii. Set up introductory meetings at units. These meetings will be an
introduction to crime prevention, and a question and answer session.
Special concerns and problem areas will be discussed at this meeting.
Meetings will also serve to introduce neighborhood watch, engraving and
Operation I.D.
iv. Set up engraving and Operation I.D. Determine the best way to
encourage resident involvement. Options will include structured times
for engraving with police officers present, or group lessons in engraving,
with time scheduled for engravers to be distributed.
v. Personal safety meetings, including gang and drug activity awareness.
Sessions will include how to report suspicious circumstances.
vi. Introduce Neighborhood Resource Officers to individual units. Have
Neighborhood Resource Officers (NRO) prepare an introduction and
presentation of community policing to explain their function and role.
vii. Establish times for on site visits, including time to allow residents to talk
informally with officers at the units.
viii. Solicit tenant input by YHA staff distribution of a tenant survey to be
produced in English and Spanish by Yakima Police Department. The
purpose of the survey is to provide Yakima Police Department specific
citizen concerns and comments pertinent to their neighborhood safety.
Following compilation of tenant comments in the surveys, Officers will
meet again with tenants in order to be responsive to any concerns
expressed.
2. Consideration. The funding for this Agreement is from a Public Housing Drug
Elimination Program Grant. In consideration for the services provided hereunder by the City,
the Authority shall pay the City a total of not more than Six Thousand Dollars ($6,000.00). The
City will bill the Authority on a monthly basis. The billing documentation shall include a
summary description of contacts made and services provided during the billing period. The
Authority shall pay the City within thirty (30) calendar days of receipt of each bill.

3. Term of Agreement. The term of this Agreement shall be retroactive to April 1,
1998 and terminate at midnight, August 31, 1999, unless terminated by either party in
accordance with Section 8 of this Agreement.
4. Nondiscrimination Provision. During the performance of this Agreement, the
Authority shall not discriminate on the basis of race, age, color, sex, religion, national origin,
creed, marital status, political affiliation, or the presence of any sensory, mental or physical
handicap. This provision shall include but not be limited to the following: employment,
upgrading, demotion, transfer, recruitment, advertising, layoff or termination, rates of pay or
other forms of compensation, and selection for training.
5. No Insurance. It is understood the City does not maintain liability insurance for
the Authority and/ or its employees.
6. Indemnification and Hold Harmless.
a. The Authority agrees to hold harmless, indemnify, and defend the City, its
elected officials, officers, employees, and agents from and against any and all suits, actions,
claims, liability, damages, judgments, costs and expenses (including reasonable attorney's fees)
which result from or arise out of the sole negligence of the Authority, its officers, employees,
and agents in connection with or incidental to the performance or non-performance of this
Agreement.
b. The City agrees to hold harmless, indemnify, and defend the Authority, its
officers, employees, and agents from and against any and all suits, actions, claims, liability,
damages, judgments, costs and expenses (including reasonable attorney's fees) which result
from or arise out of the sole negligence of the City, its elected officials, officers, employees, and
agents in connection with or incidental to the performance or non-performance of this
Agreement.
c. In the event that the officials, officers, agents, and/or employees of both the City
and the Authority are negligent, each party shall be liable for its contributory share of
negligence for any resulting suits, actions, claims, liability, damages, judgments, costs and
expenses (including reasonable attorney's fees).
d. Nothing contained in this Section or this Agreement shall be construed to create
a liability or a right of indemnification in any third party.
7. Non -Waiver. The failure of the City to insist upon strict performance of any
provision of this Agreement or to exercise any right based upon a breach thereof or the
acceptance of any performance during such breach shall not constitute a waiver of any right
under this Agreement.

8. Termination. Either party may terminate this Agreement, with or without cause,
by giving the other party twenty (20) days prior written notice of termination; provided,
however, that the City shall be entitled to compensation for services rendered hereunder
through the date of termination.
9. Severability. If any portion of this Agreement is changed per mutual agreement
or any portion is held invalid, the remainder of the Agreement shall remain in full force and
effect.
10. Integration and Supersession. This Agreement sets forth all of the terms,
conditions, and agreements of the parties relative to the subject matter hereof and supersedes
any and all such former agreements which are hereby declared terminated and of no further
force and effect upon the execution and delivery hereof. There are no terms, conditions, or
agreements with respect thereto, except as herein provided and no amendment or modification
of this Agreement shall be effective unless reduced to writing and executed by the parties.
11. Notices. Unless stated otherwise herein, all notices and demands shall be in
writing and sent, or hand -delivered, to the parties to their addresses as follows:

demands shall be sent by registered or certified mail, postage prepaid, or hand -delivered. Such
notices shall be deemed effective when mailed or hand delivered at the addresses specified
above.
12. Governing Law. This Agreement shall be governed by and construed in
accordance with the laws of the State of Washington.
13. Venue. The venue for any action to enforce or interpret this Agreement shall lie
in the Superior Court of Washington for Yakima County, Washington.

ITEM TITLE: Consideration of a Resolution Authorizing the City Manager to
Execute an Agreement with the Yakima Housing Authority, to
Provide Additional Police Services to help Create a Drug and
Crime -free Environment and to Provide for the Safety and
Protection of the Residents in its Public Housing Developments.

SUMMARY EXPLANATION: This agreement will authorize Yakima Police Officers
to conduct on-site training classes for residents in the public housing developments.
The time frames for completing this contract will be adjusted to from December 31,1998
to August 31,1999. This change is necessary and at the request of the Yakima
Housing Authority. Expected results are to create a crime and drug-free area that
provides for safety and protection of all residents. Additional services will include site
surveys, instruction by officers aimed at operation identification, crime reporting and
crime prevention, including introductions of all neighborhood officers and the solicitation
of tenant input from a distributed survey form. Personal safety and awareness training
in the areas of gangs and drug activity will be stressed.
