ORDINANCE NO. /7a7 AN ORDINANCE accepting the revised recommendation of the Planning Commission for certain property lying West of South llg Avenue between Spruce and Division Streets in the City of Yakima Washington and declaring an emergency© WHEREAS on September 14 1960 at a regularly scheduled meeting of the City Counc11 a hearing was had upon the recommndation of the Planning Comrission that the petition that certain specified property in the City of Yakima, located West of South llt Avenue between Spruce and Division Streets and more particularly described as fol- lows to-wits Lots 1 to 7, inclusive Block 414 Bedker's and Capitol Addition; be rezoned from B-1 Modified Business Zone to B-2 Local Business Zone be denied and III WHEREAS On said September 14 1960 the City Council disagreed with the said recommendation of the Planning Commission and adopted Resolution No D-173 which denied said recommendation and requested the said Planning Commission to make a further report with respect to said petition and wHEREAS at a regular meeting of the Planning Commiseion held on September 27 1960 an additional Public hearing was duly and regularly had and subsequent thereto the said Planning Commission approved said petition for such rezone and recommended to the City Council that said property be rezoned from B-1 Modified Business Zone to B-2 Local Busieeos Zone and WHEREAS 9 The City Council finds that such recommendation for such rezoning should be approved for the following reasons to-wits That • such rezoning is in accord with good planning and with the Comprehensive Plan of the Oity of Yakima; that the majority of property owner in the -1- 1 vicinity do not oppose the change in classification; that the needs 411 of -the city and community do require such change; and that the highest and best use is for Local Business purposes now therefore, BE IT ORDAINED BY THE CITY OF YAKIMA; Section 1, That the recommendation of the Planning Commission of the City of Yakima that certain specified property in the City of Yakima Washington located West of South llt Avenue between Spruce and Division Streets and more particularly described a. follow towit; Lots 1 to 7 inclusive Block 414 Bedker's and Capitol Additions; be rezoned from B-1 Modified Business Zore to B-2 Local Business Zone be and the same 1s hereby approved and said property is hereby zoned as B..2 Local Business Zone. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the said City of Yakima. Section The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified oopy of this ordinance. Section 4. This ordinance is one to provide for the immediate preservation of the public peace property health and safety of the people of the City of Yakiina and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage approval and publication as provided by law and the City Charter.
