R-96-171 A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute an agreement with Yakima County and People for People, Inc., relating to transporting elderly and handicapped citizens. WHEREAS, Yakima County, People for People, Inc., and the City of Yakima desire to execute the attached agreement in order to secure funding for transportation services to elderly and handicapped citizens within the Yakima Metropolitan Area Transportation Study (YMATS) area, and to contract for the provision of such transportation services; and WHEREAS, the City Council deems it to be in the best interests of the City that the attached agreement document, providing for the funding and furnishing of such transportation services, be executed by the City accordingly, now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and the City Clerk of the City of Yakima are hereby authorized to execute an agreement with Yakima County and People for People, Inc., for the purposes mentioned above, a copy of which agreement is attached hereto and by reference made a part hereof. Ir. . . . • • s' . ..6' :0, % STANDARD TERMS AND PAYMENT PROVISIONS SPECIFIC PROVISIONS I APPLICABLE LAWS AND REGULATIONS The Contractor agrees that services contemplated or delivered within the terms of this Agreement and funds administered in the delivery of the specified services shall be provided in accordance with all applicable Federal, State, and local laws and regulations, in particular the following: A. CFR Title 45, Subtitle A, Part 74, (Administration of Grants) B. WAC 388-17, (Senior Citizens Services Act) 11 PROJECT DEFINITION 1 ransportation services are designed to transfer older persons to and from social services, medical and health care services, meal programs, and shopping so such services will be accessible to eligible individuals who have no other means of transportation or are unable to use existing transportation. Personal assistance for those with limited physical mobility shall be provided. 111 PARTICIPANTS The Contractor agrees that: A. The target population for transportation services are the individuals referenced in the Transportation Program Standards. B. There will be written assessment procedures utilized by the Contractor to determine if clients meet the program target population criteria. C. The indicators used by the Office of Aging and Long Tenn Care to assess its effectiveness at targeting services to individuals who may be vulnerable are: Racial minority Low-income 75 years of age or older Limited or non-English speaking Living alone ALTC funding should encourage the effective targeting of services to the vulnerable elderly by the Contractor. Specific goals to be attained for 1997 are as follows: 1. 11% Racial or ethnic minorities 2. 50% Low-income 3. 55% 75 years of age or older 4. 4% Limited or non-English speaking 5. 40% Living alone The Contractor must report on clients served in these categories. STPPFPUV - 1 f:\. \rebecea\contract\stppfpuv.doc (11/12/96) IV SERVICE SPECIFICATION The Contractor agrees that services provided within the terms of this Agreement shall meet the following specifications: A. Efforts will be made to assure access of service to the target population, to include at least the following: 1. Accessible office or site location; 2. Home visits or home delivery of services (if applicable); 3. Multicultural, bilingual persons to assist multicultural, bilingual clients in receiving services; 4. Publicity of program through public service announcements, brochures, etc.; 5. Meeting with other service providers/agencies to explain services the Contractor provides and how referral can be made; 6. Ability to serve individuals with disabilities. B. Transportation services shall be delivered in accordance with the Southeast Washington Office of Aging and Long Term Care Transportation Program Standards and information submitted in Request for Proposal. The Contractor acknowledges receipt of a copy of said standards. Services provided shall comply with said standards as presently constituted or subsequently modified and the following: ALTC funding is not to be used to displace other funding sources or used in place of other funds. ALTC funding may only cover these services: 1. Nutrition services only to City of Yakima residents; no other transportation can be provided. Clients should be referred to City of Yakima Dial -A -Ride Program. 2. Nutrition, medical and shopping transportation services for elderly persons living outside of city limits; 3. Local medical rides for Medicaid clients living in their own homes, not covered under DSHS. Prior approval must be obtained from ALTC before a ride is authorized. C. When there are multiple funding sources, ALTC may not be charged for provider to solicit bids for other contracts; coordination with other transportation programs is welcome as long as costs are allocated appropriately, i.e., vehicle depreciation, dispatching, etc. D Participant Intake Forms (PIF) or other client tracking information shall be completed and submitted as required to the Office of Aging and Long Term Care for each client served. E. Participants shall be referred to other transportation systems as determined appropriate. F. The Contractor shall establish a system through which clients of services under this approved Agreement may present grievances as outlined in the Basic Agreement, Section XVI(F). G. Services shall be provided throughout upper Yakima County. STPPFPIIV - 2 f.\ \rebcck.a\contract\stppfpuv.doc (11/12/96) V ANTICIPATED SERVICE LEVELS AND EXPENDITURE RATE The Contractor agrees that: A. The level of service to be provided shall be as described in the Specific Provisions, Section V, Subsection C, Parts 2 and 3 of this Agreement. Failure to meet the service levels as defined in this Agreement may result in a renegotiation of the funding levels provided under the terms of this Agreement; B The County may unilaterally reduce the Agreement budget within thirty (30) days of the close of the quarter by the amount of the projected quarterly expenditures left unspent at the end of the quarter. The County shall submit to the Contractor notification of intent to recapture unspent funds and a modification to the budget reflecting the adjusted changes in the Agreement. C. Unit of Service 1. Definition: a. A unit of transportation service shall be defined as one (1) mile of vehicle travel in the transportation or process of transporting eligible participants. b. A boarding shall be defined as a one passenger, one-way ride from pickup point to destination. 2. There will be 150 unduplicated individuals served by this Agreement. 3. Access by the County: The Contractor shall provide access at all reasonable times for the County to monitor and/or evaluate the provisions of services under this Agreement. The County may, with prior permission from the participant and knowledge of the Contractor, interview a certain percentage of participants to ascertain their experience with the program. B. Records and Reports: The Contractor agrees to: 1. Submit the monthly report showing service level provided by the tenth day of each month following the month during which the services were provided; 2. Submit a quarterly performance report and a quarterly revenue and expenditure report by the tenth day of the month following the end of the quarter unless otherwise approved by the County; 3. Complete and submit such additional reports as are required by the County within the specified time frames, providing the Contractor is given a written request for the reports thirty (30) days prior to the due date. C. Inventory: The Contractor agrees to: 1. Submit to the County vendor invoice(s) at the same time with the monthly billing before County reimbursement of expenditures for authorized items of $300.00, or more; 2. Complete at least once a year a physical inventory, using the forms provided by the County, of all equipment purchased with Office of Aging and Long Term Care funds. D. Contractors Meeting: The Contractor agrees to have a representative attend meetings of the Office of Aging and Long Term Care contractors and Long Term Care Planning Committee. E. Program Publication: The Contractor agrees that: 1. The program shall be publicized on a regular basis, with all publicity and printed material identifying the Southeast Washington Office of Aging and Long Term Care as a funding agency; 2. All material distributed with regards to publicizing the program contain a statement assuring non-discrimination. Following is the wording suggested: People for People does not discriminate in providing services on the grounds of race, creed, color, religion, national origin, gender, age, marital status, or the presence of any sensory, mental, or physical handicap. Materials publicizing the program must be printed in other appropriate languages in counties that have a specific minority 60+ population of three (3%) percent or more of the general 60+ population. F. Additional Remuneration Prohibited: Neither the Contractor nor any of its officers, employees, agents or representatives, shall solicit, impose any fees, or accept any remuneration whatsoever from clients, friends, relatives, or representatives of any clients for services performed for that client under this Agreement other than the client matching monies or donations (see Section I). In the event that this provision is violated, the County shall have the right to assert a claim against the Contractor on its own behalf and/or on behalf of the client. G. Private Pay: The Contractor, who offers to the general public on a private pay basis a service comparable to the service described in this Agreement, must assure that the County is not charged more for the service than the private pay fee. The responsibility lies with the Contractor to justify that a service provided at a different rate is not comparable to this service. H. Maintenance of Funding Sources: The Contractor agrees that: 1. The County funds are not used to replace funds from any other existing program funding; 2. It will continue or initiate efforts to obtain support from private sources and other public organizations for this service. 3. It will utilize new funding sources for this service if they become available through the County and it will make any changes necessary to meet the requirements of the new funding sources. I. Fees and Donations: The Contractor agrees that: 1. It will assure that older persons have the opportunity to contribute to all or part of the cost of the service, but service will not be denied if participant cannot or does not wish to contribute; 2. It shall utilize client donations to meet project expenses before using State or Federal funds. Client donations may be used to satisfy matching requirements; 3. It shall provide that the methods of receiving fees, donations and contributions from individuals shall be handled in such a manner so as not to publicly differentiate among individuals; 4. All project income derived from the provision of services described herein or incorporated by reference herein or derived or generated through program fund- raising activities or profits earned from fixed rate service shall stay with the project and shall be used to provide increased levels or improved quality of service to the target population. STPPFPUV - 5 f.\. \tebecca\contract\stppfpuv.doc (11/12/96) J. Monitoring/Assessment Procedures: The Contractor agrees to: 1. Monitor both its fiscal and program status monthly and assess its performance on program objectives and activities covered under this Agreement on an ongoing basis; 2. Monitor and assess on an ongoing basis the performance of any subcontracting agencies, and insure that funds made available are expended only in accordance with the specific provisions of this Agreement; 3. Recognize that the County will monitor and assess the activities and progress of all programs covered under this Agreement on an ongoing basis. Said monitoring and assessmentwill be accomplished through, but not limited to, review of program and financial reports, on-site visits (service delivery and administrative sites), conference with program administrators and staff, and visits by members of the Office of Aging and Long Term Care (ALTC) staff and ALTC Advisory Council. Monitoring may include assessing performance based on information submitted in Request for Proposal (RFP). Prior notice of all such visits will be provided; 4. Authorize and/or participate in any program or fiscal evaluations or studies conducted by the County or DSHS. Prior notice will be provided as well as final reports of evaluations or studies; 5. Conduct a self-evaluation of the program annually. The self-evaluation shall include a survey of at least 10% of clients utilizing the service. The Contractor shall take steps to correct deficiencies found during the internal monitoring. Monitoring reports shall be made available to the County upon request. PAYMENT PROVISIONS CONSIDERATION As consideration for services, as described in the Specific Provisions of this Agreement and in accordance with the Budget Provisions of this Agreement, the County agrees to pay the Contractor a sum not to exceed $53,200 from available funds as submitted on budget proposal packet. This total sum shall be available during the period January I, 1997 through December 31, 1997. These funds provided by the County shall be used by the City to secure Urban Mass Transportation Administration (UMTA) funds on a one-to-one match to achieve a total project funding sum of $106,400. These funds shall be used to provide Transportation services. Payment to the Contractor for this unit rate price Agreement shall be based on the unit rate of $1.51 per vehicle mile of Transportation services during the period January 1, 1997 through December 31, 1997. Client donations received in excess of $3,500 will be used to provide additional units of service at the unit rate of $1.57 per vehicle mile or be spent first before ALTC funds are used. The payment for COPES services will be in addition to the contracted amount. The COPES payment will be based on claims for reimbursement as reported on the COPES services billing. This includes clients now authorized, number of units of service and the actual number of units provided. The COPES unit rate will be $1.57. STPPFPUV - 6 f\. \rebecea\contract \stppfpuv.doc (11/12/96) Payment shall be based on claims for reimbursement as reported on the Office of Aging and Long Term Care invoice and support documentation and shall be contingent upon the receipt of all required financial and program reports by the respectively assigned due dates. The County shall renegotiate the unit rate the following contract year if revenue and expense reports indicate a profit of more than three percent (3%). The County shall not be held responsible for any financial loss suffered by the Contractor as a result of performance of services as outlined in this Agreement in the mutually agreed budget, service delivery standards, units of service and payment standards. 11 GENERAL PAYMENTS CONDITIONS The Contractor agrees to the following standards in satisfactorily performing the terms and conditions of this Agreement: A. No payment shall be made for any contracted activity rendered by the Contractor which is not identified within the terms and conditions of this Agreement and set forth within a category of the budget. B. The Contractor shall submit to the County a written request for approval of budget revision when: 1. The revision would change the scope or objectives of any contracted activity category; 2. Additional revenue is received for contracted activities within the terms of this Agreement; 3. The Contractor desires to transfer funds from one budget category to another. Budget category transfers shall, for the purpose of this Agreement, be defined as transfers inclusive of those occurring between sub -object categories when the cumulative amount of all transfers exceeds four percent (4%) of the County budgeted amount for administration or service delivery. C Payments shall be based on the County's receipt of all fiscal and programmatic reports required by this Agreement to substantiate claims for reimbursement. The County expressly reserves the right to withhold payment in whole or in part when: 1. The Contractor fails to submit all required documentation, or 2. In the County's judgment, additional information is required to substantiate the basis upon which claims for reimbursement are made, provided the request for such additional information is consistent with the requirements of this Agreement; or 3. Claims for reimbursement are inconsistent with the terms and conditions of this Agreement; or 4. Claims for reimbursement on unit rate price Agreements exceed the administrative and service delivery budgets without in-kind contributions by greater than five (5%) percent of their respective allotted amount; or STPPITUV - 7 f \. \tebccca\contract\stppfpuv.doc (11/12/96) 5. Claims for reimbursement on line -item cost Agreements exceed the administrative and service delivery budgets of County contracted funds by greater than five (5%) percent of their respective allotted amount. The County agrees to promptly notify the Contractor of any proposed reduction in funding by State, Federal, or other officials. The Contractor agrees that upon receipt of such notice it shall take appropriate and reasonable action to reduce its spending in the affected funding area so that expenditures do not exceed the funding level which would result if said proposed reduction became effective. III BILLING PROCEDURES A. The Contractor shall submit written claims for reimbursement of contracted activities provided on the appropriate forms. All payments will be based on contracted activities provided unless otherwise approved in writing by the County. B. The County agrees to make payment for contracted activities provided as approved by the Auditor of Yakima County with County warrants within twenty (20) working days, contingent upon the availability of funds, following receipt of the Contractor's claims for reimbursement, provided that claims for reimbursement are received by the County by the tenth day of each month following the month during which the services were provided. No payment shall be made in the month services are rendered unless otherwise approved by the County. If the twentieth day of a rnonth falls on a Saturday, Sunday or holiday, payment will be made the next County working day. Payments at the end of each month will be made on the last County working day for that month. STPPFPUV - 8 f \. \rebccca\contract \stppfpuv.doc (11/12/96) SOUTHEAST WASHINGTON OFFICE OF AGING AND LONG TERM CARE TRANSPORTATION PROGRAM GUIDELINES I. PROGRAM DEFINITION A. TRANSPORTATION SERVICES are designed to transport older persons to and from social services, medical and health care services, meal programs, and shopping assistance so such service will be accessible to eligible individuals who have no other means of transportation or are unable to use existing transportation. Personal assistance for those with limited physical mobility is provided. 1. REGULAR SPECIALIZED TRANSPORTATION is for service which uses designated vehicles to transport passengers utilizing special equipment when required or necessary to accommodate those with limited physical mobility. Drivers are usually paid by the provider but on occasion they may use volunteers as drivers. 2. VOLUNTEER TRANSPORTATION is provided by volunteers using their own private cars and they are reimbursed for expenses incurred. They may be used along with or as an alternative to regular specialized transportation. B. TARGET POPULATION The target population for transportation services is persons age 60 or over who 1. Need transportation to medical and health services, social services, meal programs or for shopping assistance; AND 2. Cannot manage their own transportation because they: a. Have no car, OR b. Cannot drive, OR c. Cannot afford to drive, AND d. Cannot use public transportation, OR e. Public transportation is not available or accessible. All persons served should be members of the target population. To the degree feasible, persons served should meet the vulnerability criteria listed in Attachment I. 1 II. REGULAR SPECIALIZED TRANSPORTATION A. INSURANCE 1. COVERAGE - Each vehicle in the transportation provider's fleet should be covered for at least liability and property damage. In addition, it is suggested that providers also carry coverage for comprehensive, collision and uninsured motorist in order to assure vehicle replacement if vehicles become damaged or lost. Minimum coverage for liability should be $100,000 per individual and $300,000 per occurrence, and property damage should be at least $50,000 per occurrence. 2. LOSS CONTROL The loss control program, including a designated coordinator and safety committee, establishes procedures that assure driver selection, driver training and vehicle maintenance and safety programs are effective and, if not, indicates corrective actions which can be taken. B. DRIVERS 1. SELECTION Transportation providers should assure that vehicle drivers are reliable and able to drive safely. In addition to the general personnel selection procedures of the organization, selection of vehicle drivers should include: a. Verifying that the applicant has an appropriate and valid Washington State driver's license. A commercial driver's license is required by state law for those driving a vehicle with a capacity of 16 or more. b. Verifying that the applicant has had no moving traffic violations and has not been involved in any at -fault accidents within the past three years. c. Verifying that the applicant is physically capable of safely driving the program vehicles. This verification should be in the form of a written medical statement. If such a statement is not available, some other form of creditable verification should be provided. 2 d. Verifying through the Washington State Patrol criminal identification section that the applicant has no previous record of adult or child abuse. Records must be maintained for all drivers to verify that these requirements have been met. These requirements must be updated as needed. 2. TRAINING - Transportation providers should assure that vehicle drivers are trained adequately and are able to safely use all associated equipment through a formal training plan. Providers should maintain records for all drivers to verify that training has been received. The training plan should include at least the following components: a. New drivers should be fully briefed about the transportation program, reporting forms, vehicle operation and the geographic area in which they will operate their vehicles. b. Before passengers are carried, each driver must be road tested with each kind of vehicle he/she will drive. c. Drivers must be trained to use any special equipment installed on their vehicles, such as wheelchair lifts, oxygen equipment and two-way radios. d. Within the first six months of employment, drivers must successfully complete the National Safety Council Defensive Driving Course or an approved equivalent. e. Within the first six months of employment, drivers should successfully complete the National Red Cross course in first aid training, including training in the use of cardiopulmonary resuscitation techniques (CPR). Other such courses that provide equivalent training can be substituted with approval of the Office of Aging and Long Term Care (ALTC). Refresher courses should be completed by drivers on an annual basis. f. Within the first six months of employment, drivers should be provided training that will assist them in better serving special populations within the provider's service area. This training may be given directly by the provider or through other training resources available within the community with g - approval by the ALTC. Special populations may include minority, limited -English speaking and the mentally and physically disabled. Drivers should be made aware of changes in the transportation program, reporting forms and vehicle operation through regular dissemination of such information in a formal verifiable manner, i.e., bulletin boards, newsletters, safety meetings, etc. 3. EVALUATION - The transportation provider should evaluate each driver's performance on a semi-annual basis which would include on -board evaluation of actual practice and general knowledge of the job. The results of these semi-annual evaluations should be documented. C. MAINTENANCE 1. PREVENTIVE - The transportation provider should have developed and implemented a preventative maintenance program that adequately addresses all of the maintenance needs of vehicles and related equipment, utilizing as a minimum the maintenance schedule provided by the vehicle manufacturer. 2. DOCUMENTATION - There should be a system in place to document the time and circumstances of all maintenance services received by each vehicle and related equipment. Vehicle servicing should be based upon the preventive maintenance schedule. The provider must maintain a vehicle record file containing the following information: a. Vehicle identification number b. Vehicle maintenance history, including type, date and mileage c. Vehicle loss control record listing incident description, date, mileage and driver d. Vehicle equipment check log verifying that special equipment has been checked according to the suggested schedule of the manufacturer, or at least semi- annually e. Vehicle operational and safety check log recorded at the beginning of each work day and indicating that tires, brakes, 4 lights, seat belts and other relevant equipment are operational and the vehicle has not been damaged f. Documentation that preventative maintenance was performed according to the schedule recommended by the vehicle manufacturer 3. SAFETY - The transportation provider must assure that all vehicles and associated equipment are maintained in top working condition to minimize breakdowns and decrease the chance of accidents. The provider must implement a maintenance and safety program which includes; a. A preventative maintenance schedule which incorporates at a minimum the schedule recommended by the vehicle manufacturer. b. Installation of the following equipment on each vehicle: (1) First aid kit (2) Fire extinguisher which is U. S. Coast Guard approved (3) Accident report forms (4) Triangular reflective warning devices. (5) Flashlight (6) Chains or other traction aids (seasonal) III. VOLUNTEER TRANSPORTATION A. AGENCY AFFILIATION Volunteer drivers should perform their functions under the direction of a legally constituted agency. While the volunteer's vehicle is in use on agency directed business, the volunteer is an agent of the agency. B. INSURANCE COVERAGE Each volunteer is recommended to carry the same amount of insurance as recommended for providers of Regular Specialized Transportation services; however, volunteers, at the minimum, are required to carry the state mandatory minimum amounts of insurance. 5 C. DRIVERS 1. SELECTION - Any program utilizing volunteers should assure that they have a valid Washington State driver's license and have had no at -fault accidents in the past three years. They must be physically capable of safely driving their vehicles. They must not be taking any medications that would affect their driving performance. Volunteers should be willing to maintain records and accept, record and deposit client donations in an atmosphere that protects the client's right to confidentiality. 2. TRAINING - Training of volunteer drivers should include orientation to the sponsoring agency and the purpose of the program, role of volunteers, rights and responsibilities, reimbursement, reporting requirements and evaluation. On-going in-service training should be provided to volunteers as opportunities arise and should be coordinated with other community programs to increase the volunteer's knowledge of services available for older persons in the community. 3. EVALUATION - At least annually, each volunteer driver should have all of their job application information updated so that any change in their status which affects their ability to perform as a volunteer driver would be noted. At the same time their performance and job responsibilities should be reviewed. Any accident involving a volunteer performing agency -sponsored activities should be investigated immediately by the agency. A report of the accident should be placed in the volunteer's personnel file. REFERRAL TO INFORMATION AND ASSISTANCE/CASE MANAGEMENT (I&A/CM) Subject to client consent, all clients who appear to meet the vulnerability criteria listed in Attachment I should be referred to the I&A component of the I&A/CM program for screening to determine the need for case management services. 6 i Attachment I Page 1 TRANSPORTATION PROGRAM GUIDELINES VULNERABILITY CRITERIA A person is considered vulnerable if he/she meets the following criteria: 1. Is unable to perform one or more of the activities of daily living listed below without assistance due to physical, cognitive, emotional, psychological or social impairment. - Ambulation - Bathing - Cooking - Dressing or undressing - Eating - Housework - Laundry - Manage medical treatments (prescribed exercises, change of dressings, injections, etc.) - Manage medications (what to take, when to take, how to store properly, etc.) - Manage money (budgeting, check writing, etc.) - Personal hygiene and grooming - Shopping - Telephoning - Toileting - Transfer (getting in and out of bed/wheelchair) - Transportation OR 2. Has behavioral or mental health problems that could result in premature institutionalization, or is unable to perform the activities listed in #1, or is unable to provide for his/her own health and safety primarily due to cognitive, behavioral, psychological/emotional conditions which inhibit decision- making and threaten the ability to remain independent. AND 3. Lacks an informal support system: Has no family, friends, neighbors or others who are both willing and able to perform the service(s) needed or the informal support system needs to be temporarily or permanently supplemented. CONTRIBUTION POLICY Persons who receive services funded by Title III of the Older Americans Act must be given a free and voluntary opportunity to contribute to the cost of services provided. The same opportunity must be extended to persons who receive an SCSA-funded service which is not subject to a means test. The service provider must protect each person's privacy with respect to his/her contribution, establish procedures to safeguard and account for all contributions made by users of the service and use all such contributions to expand the service which received the contribution. The service provider may develop a suggested contribution schedule. If a schedule is developed, the provider must consider the income ranges of older persons in the community and the provider's other sources of income. No otherwise eligible person may be denied service because he/she will not or cannot contribute to the cost of the service. 8
