AN ORDINANCE relating to Leaves of Absence and amending Yakima Municipal Code
Section 2.40.050 Military Leave.
follows:
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 2.40.050 of the Yakima Municipal Code is amended to read as
2.40.050 Military leave.
Leave not to exceed twenty-one days during each year beginning October
1st and ending the following September 30th, over and above annual vacation or
sick leave, may be allowed any employee who is a member of the National Guard
or of any organized reserve or Armed Forces of the United States. The employee
will be paid their normal pay during such military leave period when taking part in
active training duty. No days shall be charged against the twenty-one day military
leave period for nonwork days before the beginning or after the end of any active
military leave period. (Ord. 2014-026 § 1 (part), 2014: Ord. 2014-023 § 6 (part),
2014: Ord. 1911 § 1, 1976: Ord. 69 § 1 (part), 1960).
Section 2. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter.

ITEM TITLE: Ordinance relating to Leaves of Absence and amending Yakima
Municipal Code Section 2.40.050 Military Leave

SUMMARY EXPLANATION:
The language in Yakima Municipal Code Section 2.40.050 Military Leave is not consistent with
RCW 38.40.060, therefore, it needs to be changed. The current language allows a maximum of
15 days leave per year and state law allows 21 days per year.
