YAKIMA CITY COUNCIL MINUTES April 1, 2025 City Hall - Council Chambers - 129 N 2nd Street, Yakima WA 5:30 PM City Council Regular Meeting - Conducted in person and virtually via Zoom 1) Roll Call Present: Mayor Patricia Byers, presiding; Assistant Mayor Matt Brown and Councilmembers Reedy Berg, Janice Deccio, Rick Glenn, Danny Herrera and Leo Roy Staff: City Manager Vicki Baker, City Attorney Sara Watkins and City Clerk Rosalinda I barra 2) Pledge of Allegiance Mayor Byers led the Pledge of Allegiance. 3) Interpreter Services Mayor Byers introduced Teresa Castaneda who announced interpreter services are available in Spanish. 4) Public Comment Patty Maggard Prediletto, City resident, noted the importance of the two senior centers and pool facilities for patrons and community members and expressed concerns about the budget. Lea Draven, City resident, expressed concern about the Council's recent decision to draft a letter in opposition to House Bill 1380. Shelley White, City resident, spoke in opposition to middle-housing requirements and provided related handout to Council. Ron Torres, City resident, spoke in opposition to middle-housing, specifically related to population and housing availability. 5) Open Discussion for the Good of the Order 5.A Draft Proclamation for Arbor Day 2025 MOTION: Deccio moved and Brown seconded to approve the proclamation. The motion carried by unanimous vote. 5.B Draft Proclamation for National Day of Prayer MOTION: Brown moved and Deccio seconded to pass the proclamation. The motion carried by unanimous vote. April 1, 2025 -Yakima City Council Meeting Minutes Page 1 of 5 9 5.0 Draft Proclamation for America's 250th anniversary "Two Lights for Tomorrow" Initiative MOTION: Deccio moved and Brown seconded to pass the proclamation. The motion carried by unanimous vote. 6) Council Reports Assistant Mayor Brown recognized the appearance of Parks and Recreation Manager Ken Wilkinson on the Kelly Clarkson Show presenting the Randall Park Day proclamation and the Uzo Aduba Disc Golf Course. The video clip was aired for the audience. 7) Consent Agenda Mayor Byers referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. Items E and K were removed from the Consent Agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion-see motion directly below.) MOTION: Brown moved and Deccio seconded to approve the consent agenda as read. R-2025-061, A RESOLUTION authorizing an Equitable Sharing Agreement and Certification with the United States Department of Justice. April 1, 2025 -Yakima City Council Meeting Minutes Page 2 of 5 10 7.1 Resolution authorizing Yakima Police Corrections Sergeants (Teamsters Local 760) Collective Bargaining Agreement for 2024-2025 RESOLUTION NO. R-2025-062, A RESOLUTION authorizing a collective bargaining agreement with the Yakima Police Corrections Sergeants (Teamsters Local 760) for January 1, 2024 - December 31, 2025. 7.J Resolution authorizing Yakima Supervisors &Administrative Unit (Teamsters Local 760) Collective Bargaining Agreement for 2024-2027 RESOLUTION NO. R-2025-063, A RESOLUTION authorizing a collective bargaining agreement with Teamsters Local 760 representing the Yakima Supervisors &Administrative Unit for January 1, 2024 - December 31, 2027. 7.K This item was removed from the Consent Agenda Items Removed from Consent Agenda 7.E Resolution authorizing a Temporary Water Transfer Interlocal Agreement with the City of Tieton and Yakima-Tieton Irrigation District Water and Irrigation Manager Mike Shane briefed the Council on the proposed resolution. The City Clerk read the resolution by title only. After Council discussion, MOTION: Brown moved and Deccio seconded to approve Item E [adopting the resolution]. The motion carried by a 6-1 roll call vote; with Berg voting no. RESOLUTION NO. R-2025-058, A RESOLUTION authorizing a lease agreement with the City of Tieton and Yakima-Tieton Irrigation District to lease 31 shares of Irrigation water to the City of Tieton for the water year 2025. 7.K Ordinance amending Yakima Municipal Code Chapter 12.01, adding Section 12.01.080 regarding violations Community Development Director Bill Preston briefed Council on this matter for Council consideration. The City Clerk read the ordinance by title only. After Council discussion related to concerns imposing a penalty for violations, MOTION: Deccio moved and Brown seconded to pass the ordinance. The motion failed by 4-3 roll call vote; with Byers, Glenn, Roy and Berg voting no. AN ORDINANCE amending the City of Yakima Municipal Code, Title 12, Development Standards, adding Section 12.01.080 regarding violations. 8) Public Hearings None. 9) Department Items 9.A Ordinance amending the 2025-2026 Biennial Budget for the City of Yakima and making appropriations from Unappropriated Fund Balances within various Funds for expenditure during 2025-2026 for various purposes (First Reading) April 1, 2025 -Yakima City Council Meeting Minutes Page 3 of 5 11 Interim Director of Finance and Budget Mike Bailey briefed Council on the items included in the proposed ordinance amending the 2025-2026 Biennial Budget. The City Clerk read the ordinance by title only. First Reading of An Ordinance amending the 2025-2026 Biennial Budget for the City of Yakima and making appropriations from Unappropriated Fund Balances within various Funds for expenditure during 2025-2026 for various purposes (First Reading). 9.B Cost benefit analysis of animal licensing fees contributing to animal control Yakima Police Sergeant Ryan Wisner provided in depth information on the Community Services Officer's role in responding to animal control enforcement complaints and dog licensing. Sergeant Wisner also provided a comparison of expenses and revenues in 2024, noting the number of cases filed in 2024 were 164. The amount of fines assessed in 2024 was $100,428.43 with approximately 18% collected thus far, with several cases on payment plans. Councilmembers discussed the idea of requiring a chip on dogs in lieu of an animal license; however, no action was taken. 9.0 Resolution approving an agreement with the Yakima Humane Society for animal sheltering services Yakima Police Department Police Chief Shawn Boyle briefed Council on the proposed agreement with the Yakima Humane Society for animal sheltering services. The City Clerk read the resolution by title only. MOTION: Deccio moved and Herrera seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2025-064, A RESOLUTION authorizing the City Manager of the City of Yakima to execute a contract between the City of Yakima and the Yakima Humane Society, a non-profit corporation. 9.D Resolution authorizing a SIED funding agreement with Yakima County for a Minimum Revenue Guarantee Director of Yakima Air Terminal Rob Hodgman briefed Council on the proposed resolution accepting SIED funds to support additional flights from the Yakima Air Terminal. The City Clerk read the resolution by title only. MOTION: Brown moved and Deccio seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2025-065, A RESOLUTION authorizing that SIED 2025 Funding Agreement between Yakima County and City of Yakima for Minimum Revenue Guarantee ("Agreement"). 9.E Community at a Crossroads presentation City Manager Vicki Baker shared her presentation entitled "Community at a Crossroads" about the City's priority-based budgeting process and the current April 1, 2025 -Yakima City Council Meeting Minutes Page 4 of 5 12 financial challenges. The presentation will be shared with the community to inform the public about the situation the city is faced with and gather feedback through outreach, education, and a budget survey. It is anticipated that staff will report to Council with recommendations in May 2025 and adjustments to the mid-biennial budget will be reviewed in the fall of 2025. 9.F Discussion of Parking Permits City Manager Vicki Baker introduced the discussion regarding downtown parking permits stating that the city has reached the limit of available parking permits. City Attorney Sara Watkins provided potential options for Council's consideration: to increase the percentage of parking permits to 65%; to delegate to the City Manager the flexibility and authority to go above 60%; or do nothing at this time. After Council discussion, MOTION: Glenn moved and Deccio seconded to adopt the option that gives the City Manager flexibility [directing staff to place on the next Council agenda an ordinance providing the City Manager discretion]. The motion carried by unanimous vote. 10) City Manager Update City Manager Baker acknowledged the 20th anniversary of ITS Division Manager John Carney with the City of Yakima. 11) Other Business None. 12) Adjournment MOTION: Brown moved and Deccio seconded to adjourn to the next City Council study session on April 8, 2025, at 5:00 p.m. in the Council Chambers at City Hall. Ron Torres, City resident, spoke about research relating to single-family housing, primarily middle housing laws and illegal immigration. Shelley White, City resident, spoke about and distributed a handout about population growth and immigration in Washington state related to recent housing laws changes. 3) Study Session Items 3.A Arbor Day proclamation Councilmember Deccio proclaimed the second Saturday in April as Arbor Day in the City of Yakima and recognized the Yakima Area Arboretum's Arbor Festival as the City's official celebration. Garrett Brenden, Yakima Area Arboretum Education Director, accepted the proclamation. 3.B Presentation regarding the current status of City jail Yakima Police Department Commander Maritza Davis and Yakima Police Chief Boyle presented information about the Yakima City Jail, from its inception to its current state. The Yakima City Jail opened in 1996 and houses male inmates charged with misdemeanors and gross misdemeanors. Male inmates that require a higher level of care and female inmates are housed at the Yakima County Jail. While limited in services offered, one thing the court allows is the ability for inmates to enroll in electronic home detention, resulting in reduced jail costs. At full staff, the Corrections team includes 15 staff members who are certified by the Criminal Justice Training Commission. Commander Davis detailed the main functions provided by corrections officers, expanding on services impacted by inmates suffering from mental health illnesses and substance abuse disorders. The most notable challenge Commander Davis reported is staff shortages and recruitment efforts. Her top goals are to fill existing vacancies and attain jail accreditation through the Washington Association of Sheriffs and Police Chiefs (WASPC). April 8, 2025—Yakima City Council Meeting Minutes Page 1 of 2 14 Judge Aryn Masters discussed the benefits that the City jail brings to the municipal court system and how the jail interacts with the Court system. 3.0 Discussion regarding the process of City of Yakima Utility Billing Collection Stream Utility Services Manager Anabel Chavez presented a detailed overview of the City's utility billing collection process. She outlined the procedures on how customers can open a residential or commercial utility account, allowing for property owners to stay informed of their tenant's accounts. Regarding the utility billing cycle and delinquent turn offs, Ms. Chavez explained that payment arrangements are offered to eligible account holders. MOTION: Glenn moved and Roy seconded to direct the City to bring a discussion to the Council on the second business meeting in May regarding whether or not the City can reserve the right to collect delinquent tenant accounts from the property owner [YMC 7.50.080G]. The motion carried by unanimous vote. 3.D Ordinance amending the City of Yakima Municipal Code Section 9.50.220: Long- term parking permits City Attorney Sara Watkins briefed the Council on the proposed ordinance relating to parking permits. The City Clerk read the ordinance by title only. MOTION: Brown moved and Deccio seconded to pass the ordinance. The motion carried by a 7-0 roll call vote. ORDINANCE NO. 2025-011, AN ORDINANCE amending the City of Yakima Municipal Code Section 9.50.220: Long-term parking permits. 4) Adjournment MOTION: Brown moved and Deccio seconded to adjourn to the next City Council regular meeting on April 15, 2025, at 5:30 p.m. in the Council Chambers at City Hall.
