For Meeting of: April 1, 2025 ITEM TITLE: Ordinance amending Yakima Municipal Code Chapter 12.01, adding Section 12.01.080 regarding violations SUBMITTED BY: Bill Preston, Community Development Director/Interim City Engineer SUMMARY EXPLANATION: This ordinance proposes adding a section to Chapter 12.01 (Construction of Public Works Improvements) to address violations to this chapter. The new section references to YMC 8.01.010 as these are the same procedures we would like to apply to Title 12 and much of the public works improvements that are regulated by Title 12 are within the right-of-way and therefore also relate back to Title 8. ATTACHMENTS: Ordinance_YMC 12.01.080 YMC 12.01 Redline-Final.pdf 89 ORDINANCE NO. 2025- AN ORDINANCE amending the City of Yakima Municipal Code, Title 12, Development Standards, adding Section 12.01.080 regarding violations. WHEREAS, the Yakima Municipal Code establishes standards for the design and construction of public works improvements in conjunction with subdivision, development, or redevelopment of real property; and WHEREAS, the code is hereby amended to provide better consistency throughout the code regarding the procedures and penalty fees pertaining to violations of the code as it relates to the right of way; and WHEREAS, the City Council of the City of Yakima finds that it is in the best interest of the City and its residents to amend the municipal code relating to violations of Title 12; now, therefore BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 12.01.080: Penalty for violation—Each day a separate offense, is added as a new section to Title 12 of the Yakima Municipal Code, and reads as follows: 12.01.080 Penalty for violation—Each day a separate offense. Violations to this chapter shall follow the procedures found in YMC Chapter 8.01.010. Section 2. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 3. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter.
