Yakima INDEX \ 2015 1994 149 WHEREAS, SEPA Environmental Review was completed with a determination of Nonsignificance issued on December 17, 2024, which was not appealed (SEPA#016-24); WHEREAS, the Yakima Planning Commission held an open record public hearing on January 8, 2025 to hear testimony from the public, consider the Rezone, and provide a recommendation to the Yakima City Council; Now therefore, the Yakima Planning Commission presents the following findings of fact, conclusions, and recommendation to the Yakima City Council: APPLICATION #: RZ#005-24, SEPA#016-24 APPLICANT: Digital Design & Development APPLICANT ADDRESS: 1450 N. 16th Ave. #102, Yakima, WA 98902 PROJECT LOCATION: 103, 105, 107 N. 40th Ave., & 3902 Summitview Ave. PARCEL(S): 181322-42486, -42487, -42488, -42489, -42490, & -42492 I. FINDINGS OF FACT: A. The applicant requests to Rezone from Single-Family Residential (R-1) to Small Convenience Center (SCC). B. The subject property is approximately 4 acres in size and is surrounded by commercial and residential uses with commercial and residential zoning. C. The City of Yakima Planning Division provided a detailed staff report to the Planning Commission for review during its January 8, 2025 public hearing, with the recommendation of APPROVAL of the proposed rezone. D. The proposed Rezone from Single-Family Residential (R-1) to Small Convenience Center (SCC) is consistent with the applicable approval criteria in YMC § 15.23.030, as follows: 1. Leanne Liddicoat, representing Lincoln Legacy West LLC, testified in favor of the proposed rezone. 2. Daniel Tilley, commercial representative for the developer, testified in favor of the proposed rezone. 3. Angela Gondo, the manager of the property at the corner of Summitview Ave. and N. 40th Ave. which is currently zoned SCC, had concerns about how the future development would affect her property, specifically regarding access and traffic. 4. Anna Shay, a nearby resident, had concerns about how the future development would affect the surrounding neighborhood. 5. The property is suitable for uses within the SCC zoning district. DOC. 2 INDEX 150 6. The SCC zoning district is an implementing zone of the Community Mixed Use Future Land Use Designation. 7. The property is currently capable of being served by all necessary public utilities, or have utilities extended, and can be accessed by public streets. 8. The proposed Rezone is considered compatible with the surrounding neighborhood and no mitigation is proposed at this time. 9. The public need for this Rezone is to provide for additional developable commercial land. II. MOTION Based on the testimony and evidence presented during the public hearing, it was moved and seconded that the City of Yakima Planning Commission draft findings of fact and forward a recommendation of approval, to the Yakima City Council. The motion carried 9-0. III. RECOMMENDATION The Planning Commission of the City of Yakima, having received and considered all evidence and testimony presented at the public hearing, and having received and reviewed the record herein, hereby recommends that the City Council of the City of Yakima APPROVE the proposed Rezone (RZ#005-24) from Single-Family Residential (R-1) to Small Convenience Center (SCC). DESCRIPTION OF REQUEST: Proposal to rezone six parcels totaling 4 acres from Single-Family Residential (R-1) to Small Convenience Center (SCC). II. SUMMARY OF DECISION: The Administrative Official recommends approval of the Rezone, subject to conditions. III. FACTS: A. Processing 1. The applications for a Rezone and Environmental Review were received on August 22, 2024. 2. The applications were deemed complete for processing on November 7, 2024. 3. The applications are being processed under YMC Ch. 15.23 (Amendments and Rezones) and YMC Ch. 6.88 (Environmental Review). 4. Pursuant to YMC Ch. 1.42 and YMC § 15.23.030, the Planning Commission has the authority to hold a public hearing and provide a recommendation to the City Council on a Rezone request. 5. Public Notice: In accordance with YMC § 15.11.080 and YMC § 16.05.010, notice was provided for this application as follows: DOC. Yakima INDEX mg 4. .1\ `` 2015 1994 153 a. The subject property was posted with a land use action sign on October 26, 2024. b. A Notice of Application and Environmental Review was sent to the applicant, SEPA agencies, and adjoining property owners within 300 feet of the subject property on November 12, 2024. c. A Notice of Public Hearing and Determination of Nonsignificance (DNS) was sent to the applicant, SEPA agencies, and adjoining property owners within 300 feet of the subject property on December 17, 2024. d. A legal notice was provided in the Yakima Herald-Republic on December 17, 2024. B. Environmental Review: This application was required to undergo State Environmental Policy Act (SEPA) review because it was not reviewed as part of the previous comprehensive plan update. Notice was mailed on November 12, 2024, and the public comment period ended on November 26, 2024. Two comments were received, which are outlined in Section IV (C). C. Current Zoning and Land Use 1. The subject property is approximately 4 acres in size and is zoned Single-Family Residential (R-1). The parcels are currently occupied by single-family homes and a church. 2. The surrounding properties contain uses and zoning as follows: Direction Zoning Land Use North B-1, SCC Commercial South R-1 Residential East R-1, SCC _ Residential, Commercial _. West R-1, SCC Residential, Commercial 3. Existing Infrastructure a. The property is accessed by Summitview Ave. and N. 40th Ave., which are Principal Arterials, and N. 39th Ave., which is a Local Access street. b. The property is served by City of Yakima sewer and water and Nob Hill Water Association water. D. Statement of Cause— Rezone: Pursuant to YMC Ch. 15.23, the applicant provided the following paraphrased statements explaining their reasons for the proposed Rezone: 1. How is the subject property suitable for uses permitted under the proposed zoning? Lincoln Legacy West LLC DOC. RZ#005-24, SEPA#016-24 INDEX 2 CI\ ,T 154 There are six parcels in this rezone application, located at the corner of 40th and Summitview Avenue with frontage on 40th Avenue, Summitview Avenue, and 39th Avenue. All four corners of this intersection are zoned SC, as well as the NE corner of 39th Avenue. Six of the seven parcels owned by Lincoln Legacy West are zoned R-1 with the seventh parcel zoned SCC. Proposed uses or office, retail, daycare, or a mixed-use building all require Type 1 review. 2. How is the rezone request in compliance with and/or how does the request deviate from the Yakima Urban Area Comprehensive Plan? The future land use is Community Mixed Use, suitable for SCC zoning. The proposed rezone does not deviate from the Yakima Urban Area Comprehensive Plan. 3. Are there adequate public facilities, such as traffic capacity, sewer services, potable water, stormwater drainage, schools, fire and police services, and other public services and infrastructure existing on and around the subject property? The property has been developed, so roads, utilities, and other public services are available at the site. Are the existing public facilities capable of supporting the most intensive use of the new (requested) zone? If not, what mitigating measures are going to be implemented to address any short falls in public services that may exist? Existing public facilities will be able to support the proposed office, retail, mixed- use and daycare uses. Not short falls are anticipated. 4. How is the proposed zone change compatible with the existing neighboring uses? Immediately adjacent to these parcels is a mixed-use building with salon, spa, office, and pharmacy services to the north, and residential to the south across the canal. On the north, west, and east sides of Summitview Avenue are retail, food service, and office. The proposed uses are compatible with these neighboring uses. What mitigating measures are planned to address incompatibility, such as sitescreening, buffering building design, open space, traffic flow alteration, etc.? The adjacent mixed use building is zoned SCC so no mitigation measures are planned. The south parcel line is a canal that separates the residential from commercial uses. This boundary will be fenced with landscaping. Parking will be modified with the existing lots being restriped. 5. What is the public need for the proposed change? Local businesses are a vital community need and Yakima would benefit from additional capacity for small retail and office based services. The owner is actively seeking a daycare business for this location, which is also compatible Lincoln Legacy West LLC DOC. RZ#005-24, SEPA#016-24 INDEX 3 4__.w_�'►`� 155 with the neighborhood. All of these uses meet the definition of a Community Mixed Use development. IV. FINDINGS A. Rezone Approval Criteria: In accordance with the provisions of YMC § 15.23.030 (D) (1-7), recommendations to approve or deny proposed rezones shall include the following consideration: 1. The testimony at the public hearing: A Notice of Application was mailed to SEPA agencies and all property owners within 300 feet of the subject properties on November 12, 2024, wherein the public was invited to submit written comments on the SEPA application. Notice of the public hearing was sent on December 17, 2024, wherein the public was invited to submit written and/or oral comments at the public hearing on this proposed rezone. Two comments were received prior to the drafting of this recommendation. Any testimony at the hearing can be considered by the Planning Commission. 2. The suitability of the property in question for uses permitted under the proposed zoning: The subject property is suitable for uses permitted in the SCC zoning district. 3. The recommendation from interested agencies and departments: No agencies or departments have registered any opposition to this rezone. 4. The extent to which the proposed amendments are in compliance with and/or deviate from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of this title: The SCC zoning district is an implementing zone of the Comprehensive Plan 2040 designation of Community Mixed-Use and is compatible with the following goals and policies: • Goal 2.1: Establish a development pattern consistent with the community's vision. o Policy 2.1.1: Designate the general distribution, location, and extent of the uses of land for housing commerce, recreation, open spaces, public utilities, and facilities and other uses. o Policy 2.1.4: Manage and maintain the City's Official Zoning Map to ensure continued consistency with the Future Land Use Map. • Goal 2.5: Enhance the character, function, and economic vitality of Yakima's arterial corridors and mixed-use centers. DOC. Lincoln Legacy West LLC INDEX RZ#005-24, SEPA#016-24 v 1 4 156 o Policy 2.5.1: Allow for a mixture of compatible land uses along corridors and within mixed-use designated areas. This includes the integration of multi-family residential and office uses with retail service and commercial uses. Provide zoning and design standards to maintain compatibility between different uses and zones. o Policy 2.5.3: Utilize strict access management standards to enhance safety and maintain the arterial traffic functions of the corridor. 5. The adequacy of public facilities, such as roads, sewer, water and other required public services: This property is able to be served by all public utilities necessary to support future development. 6. The compatibility of the proposed zone change and associated uses with neighboring land uses: The proposed rezone is compatible with existing neighboring land uses. The property is currently occupied by a church and single-family homes. 7. The public need for the proposed change: The public need for this proposed change is to enable additional land uses on a property adjacent to commercial zoning with commercial uses. B. Development Services Team (DST) Review On October 29, 2024, a DST meeting was held to discuss the possible impacts of this rezone, and the following comments were received: 1. Engineering a. Engineering has no issues with the potential rezone. When a project based land use is submitted Engineering will review and comment at that time for what will be required. 2. Nob Hill Water Association a. Any future project on these sites will most likely be served by the City Of Yakima's water system. 3. Surface Water a. As this project involves redeveloping multiple acres, a Large Project Stormwater Permit shall be required from the applicant. The'requirements of a Large Project Stormwater Permit are: • Drainage plan(s) and calculations • Stormwater maintenance agreement and plan • Proof that the maintenance agreement was recorded in the Yakima County Auditor's Office • Construction Stormwater Pollution Prevention Plan (SWPPP) or Erosivity Waiver. The Construction SWPPP (or Erosivity Waiver Certificate DOC Lincoln Legacy West LLC <<kq` Y RZ#005-24, SEPA#016-24 l 5 157 Statement) shall be reviewed and approved by the Surface Water Engineer prior to any grading or construction. A Temporary Erosion and Sediment Control (TESC) plan shall be submitted for approval. • In lieu of turning in a Construction Stormwater Pollution Prevention Plan, the applicant can satisfy this requirement by obtaining a Construction Stormwater General Permit through the Washington State Department of Ecology. A copy of the signed General Permit shall be delivered to the Surface Water Engineer. Go to https://ecology.wa.gov/regulations- permits/permits-certifications/stormwater-general-permits/construction- stormwater-permit for more information on how to apply for the General Permit. • A narrative explaining how Core Elements 1-8 are being satisfied. • An operation and maintenance plan for the perpetual maintenance of the facilities is now required. b. Grading and/or building permits shall not be issued without the project site first passing an erosion control inspection. Complete stormwater design plans, specifications and runoff/storage calculations supporting the stormwater design are required pursuant to the Eastern Washington Stormwater Manual and City of Yakima standards. These plans and control measures must be completed by a licensed Professional Engineer and then be reviewed and approved by the City of Yakima Surface Water Engineer prior to construction. c. In accordance with the August 2019 edition of the Department of Ecology's Stormwater Management Manual for Eastern Washington (SMMEW), Underground Injection Control (UIC) wells constructed on or after February 3, 2006 are considered new and must be registered with the Department of Ecology (DOE) 60 days prior to construction. To register your UIC wells, you must go through the Secure Access Washington website. Go to https://secureaccess.wa.gov/ecy/wgwebportal/to create an account and register your wells. UIC wells that receive polluted runoff shall retain the larger of the 100-year 3-hour and 100-year 24-hour storms and shall be designed for treatment using Table 5.23 of the SMMEW. d. More information on the Industrial Stormwater General Permit Notice of Intent can be found at https://ecology.wa.gov/Regulations-Permits/Guidance- technical-assistance/Water-quality-permits-guidance/WQWebPortal- guidance. 4. Traffic Engineering a. If a daycare of the size shown on the preliminary plan were to be proposed, we would require a Traffic Impact Analysis (TIA) instead of just a TCO. The impacts to the already congested 40th Ave/Summitview intersection could be significant. 5. Water/Irrigation a. City of Yakima Water is available to provide domestic and fire protection services to any future projects on these sites. DOC. Lincoln Legacy West LLC INDEX RZ#005-24, SEPA#016-24 6 158 6. Traffic Concurrency Verification a. Although there is no TCO required for this rezone, if a daycare of the size shown on the preliminary plan were to be proposed, we would require a Traffic Impact Analysis (TIA) instead of a TCO. The impacts to the already congested 40th Ave/Summitview intersection could be significant. C. Public Comments The following comment from the public was received: I am writing in my independent capacity to express my support for the rezone application (RZ#005-24) submitted by Lincoln Legacy West LLC. As a housing developer and nearby community resident of the Barge-Chestnut Neighborhood, I see this proposal as a much-needed addition to our neighborhood, addressing the growing demand for high-quality daycare options while revitalizing an underutilized site. The proposed design reflects a thoughtful commitment to safety, functionality, and aesthetics. Key elements such as the creation of a through street connecting 40th Avenue to 39th Avenue demonstrate the developers'intent to ease traffic hazards and promote a smoother flow of traffic, particularly for families and residents needing to travel south. The inclusion of high fencing enhances security for the children and staff, while significant green space not only provides an inviting environment but also supports outdoor play and youth development. Moreover, this facility should bring tangible economic benefits to the community by creating the proposed 29 jobs, contributing to local employment and the neighborhood's vibrancy. i can also attest to the integrity and goodwill of the property owner, Ms. Davis. When she purchased my grandparents'home (Parcel: 18132242488), she ensured they were transitioned into a better-suited home for their aging needs, away from a hazardous high-traffic area—an exceptional level of care that speaks volumes about her dedication to the community. For clarity, l had no direct financial benefit from this transaction and am offering my support purely out of goodwill, without influence or suggestion from the applicant. While I am excited about the project, I would like to offer a few suggestions to enhance safety and functionality. To address potential traffic hazards, I recommend adding a barrier on 40th Avenue to prevent left turns out of the parking lot, as this would significantly improve safety for drivers and pedestrians. I also suggest equipping the property with robust lighting and security cameras to deter loitering and enhance security for staff, families, and visitors. Additionally, I believe adding a "Do Not Block Markings"box at the intersection of N 39th Avenue and Summitview would help facilitate left turns onto the less-trafficked road, ensuring smoother traffic flow for residents and visitors alike. In conclusion, the thoughtful planning, clear community focus, and potential benefits Lincoln Legacy West LLC -' ° RZ#005-24, SEPA#016-24 U T yy 7 ..l...w = 159 of this rezone application make it an excellent fit for the neighborhood. l strongly recommend the City of Yakima to approve this application. Staff Response: This is a non-project rezone to rezone six parcels from R-1 to SCC. Land use review will be required for any future development proposed to take place on this property, which may result in requirements for frontage improvements and/or traffic mitigation. One of the requirements of the rezone application is submittal of a conceptual site plan. The conceptual site plan is nonbinding and may change in the future. The property owner will be required to go thought the land use review process in the future to determine frontage improvements along Summitview Ave. and N. 40th Ave. There will be additional opportunity to review this site at the project level. At this time there have not been any applications submitted to remove any of the existing structures on the site or build any new structures on the site. The following comment from the Department of Ecology was received: Historical aerial photos indicate these properties were occupied by orchard during the period when the pesticide lead arsenate was applied, often resulting in shallow soil contamination from lead and/or arsenic. Ecology requires soil sampling if vacant, commercial, industrial, agricultural, or existing single-family residential properties change land use as there may be an increased risk of exposure to soil with elevated concentrations of arsenic and lead. Ecology can provide sampling services at no cost. If sampling indicates elevated levels of lead and arsenic, cleanup will be required prior to occupancy. There are simple steps that can be taken to reduce exposure to the public and Ecology can provide free technical assistance. Additionally, Ecology uses Model Remedies to guide cleanup for lead and arsenic pesticide contamination in historical orchards of Central Washington. The Model Remedy document is an excellent source of technical guidance. Compliance with a Model Remedy ensures your project meets the minimum standards of the Model Toxics Control Act, and if implemented as described, your property will be successfully cleaned up to Washington State standards. Staff Response: This is a non-project rezone to rezone six parcels from R-1 to SCC. V. CONCLUSIONS A. The Planning Commission has jurisdiction to issue a recommendation on this application to the City Council. B. The proposed Rezone is consistent with the goals and policies of the Yakima Comprehensive Plan 2040. C. SEPA review resulted in the issuance of a DNS on December 17, 2024. The appeal period for this determination ended on December 31, 2024. No appeal was filed. D. No adverse impacts have been identified from granting this approval that cannot be mitigated at the time of future development. E. Public notice for this hearing was provided in accordance with zoning ordinance requirements. VI. RECOMMENDATION The Community Development Department recommends approval of this non-project Rezone request from Single-Family Residential (R-1) to Small Convenience Center (SCC). As a housing developer and nearby community resident of the Barge- Chestnut Neighborhood, I see this proposal as a much-needed addition to our neighborhood, addressing the growing demand for high-quality daycare options while revitalizing an underutilized site. The proposed design reflects a thoughtful commitment to safety, functionality, and aesthetics. Key elements such as the creation of a through street connecting 40th Avenue to 39th Avenue demonstrate the developers' intent to ease traffic hazards and promote a smoother flow of traffic, particularly for families and residents needing to travel south. The inclusion of high fencing enhances security for the children and staff, while significant green space not only provides an inviting environment but also supports outdoor play and youth development. For clarity, I had no direct financial benefit from this transaction and am offering my support purely out of goodwill, without influence or suggestion from the applicant. While I am excited about the project, I would like to offer a few suggestions to enhance safety and functionality. To address potential traffic hazards, I recommend adding a barrier on 40th Avenue to prevent left turns out of the parking lot, as this would significantly improve safety for drivers and pedestrians. I also suggest equipping the property with robust lighting and security cameras to deter loitering and enhance security for staff, families, and visitors. Additionally, I believe adding a "Do Not Block Markings" box at the intersection of N 39th Avenue and Summitview would help facilitate left turns onto the less-trafficked road, ensuring smoother traffic flow for residents and visitors alike. Toxics Cleanup Program Historical aerial photos indicate these properties were occupied by orchard during the period when the pesticide lead arsenate was applied, often resulting in shallow soil contamination from lead and/or arsenic. Ecology requires soil sampling if vacant, commercial, industrial, agricultural, or existing single-family residential properties change land use as there may be an increased risk of exposure to soil with elevated concentrations of arsenic and lead. Ecology can provide sampling services at no cost. If sampling indicates elevated levels of lead and arsenic, cleanup will be required prior to occupancy.There are simple steps that can be taken to reduce exposure to the public and Ecology can provide free technical assistance. Additionally, Ecology uses Model Remedies to guide cleanup for lead and arsenic pesticide contamination in historical orchards of Central Washington. The Model Remedy document is an excellent source of technical guidance. Compliance with a Model Remedy ensures your project meets the minimum standards of the Model Toxics Control Act, and if implemented as described, your property will be successfully cleaned up to Washington State standards.
