between the City of Yakima and the YWCA Yakima
WHEREAS, the City of Yakima Prosecution Division and the YWCA Yakima have come together to
collaborate and to make an application for OVW Fiscal Year 2024 Enhancing Investigation and
Prosecution of Domestic Violence, Dating Violence, Sexual Assault, and Stalking (EIP) Initiative grant;
and
WHEREAS, the partners listed below have agreed to enter into a collaborative agreement in which
the City of Yakima will be the lead agency and named applicant and the other agencies will be
partners in this application; and
WHEREAS, the partners herein desire to enter into a Memorandum of Understanding setting forth the
services to be provided by the collaborative; and
WHEREAS, the application prepared and approved by the collaborative through its partners is to be
submitted to the Office on Violence Against Women on or before April 30, 2024;
I) Description of Partner Agencies
City of Yakima Prosecution Division: represents the City of Yakima in the prosecution of adult
misdemeanor criminal matters occurring within the City of Yakima. The Division has a dedicated
DV unit which prosecutes crimes of domestic violence and is manned by 2 attorneys, 1.5 legal staff
and one bilingual victim assistant.. The personnel in this unit receives special training and
participates in the City of Yakima Coordinated Community Response Team(CCRT), the DV
Coalition and the DV High Risk Team.
YWCA Yakima: a non-profit non -governmental victim services organization serving the City of
Yakima. The YWCA Yakima provides counseling, shelter, and transitional housing services for
victims of Domestic Violence. The YWCA is also a member of the City of Yakima Coordinated
Community Response Team, Yakima DV Coalition and the DV High Risk Team.
11) History of Relationship
El The Prosecution Division and the YWCA Yakima have worked closely for years. For many years
the Prosecution Division did not have a system bases victim assistant and relied heavily on the
YWCA to provide services and make victim service referrals. In 2019 the City of Yakima funded a
Prosecution Division based victim assistant, the YWCA was instrumental providing and
suggesting training. The Prosecution Division victim assistant collaborates on a regular basis with
the YWCA victim advocates to provide a warm hand off for services.
El The Prosecution Division and the YWCA Yakima personnel meet daily for the CCRT meetings to
discuss emergent intimate partner DV cases with the goal of increasing victim and children safety
and holding defendants accountable. The YWCA has led the Yakima County Coalition and CCRT
for years. In 2021, we (parties to this agreement) the Yakima Police Department, Yakima County
Prosecutor, Yakirna County Probation, Aspen Victim Services, and the Yakima School District
began to collaborate in a city of Yakima specific CCRT and coalition. Yakima County is a large
County and we found that concentrating on the City of Yakima, with the densest population and
higher incidents of DV we would be able to implement change and expand services faster.
El The parties to this agreement agree that the City of Yakima Prosecution Division needs a second
victim assistant, the caseload is too high for one victim assistant to provide proactive services.
The long term goal is to demonstrate for city funders the increased services and better case
outcomes that could be provided with the addition of the second victim assistant.
NJ Development of Application
E As mentioned above, the parties collaborate on a regular basis. The CA is instrumental in
providing training and collaborating with the Prosecution victim assistant. So, it is natural, that we
would partner with the CA to provide training and we would be able to compensate the YWCA
for their efforts. Recently the City of Yakima and the CA Yakima participated in the formation
of a DV High Risk Team. The YWCA Yakima Advocated are in the process of becoming certified
to administer and train others on the DA-LE (Danger Assessment for Law Enforcement) The DA-
LE is a series of questions that has been scientifically proven to predict lethality. In addition to the
normal training the YWCA staff provide, the YWCA would train the City of Yakima victim Assistant
to administer the DA-LE to victims who come to the Prosecution Division and also make referrals
to the high risk DV team as warranted.
0 The YWCA has participated in police officer training in the past. We have many new officers.
Offering a training to help officers overcome biases would be welcome and would increase
referrals. .
It/) Roles and Responsibilities
NOW, THEREFORE, it is hereby agreed by and between the partners as follows:
0 The City of Yakima will apply for the OVW Fiscal Year 2024 Enhancing Investigation and
Prosecution of Domestic Violence, Dating Violence, Sexual Assault, and Stalking (EIP) Initiative
grant for funding to run a three year project that will involve hiring a full time bilingual victim
assistant, improving safety and communication with intimate partner DV and stalking victims, and
finally provide officer training to help officers overcome their preconceived notions and biases
concerning victims of domestic violence. Should the City of Yakima receive the grant, the
partners will:
- The Prosecution Division will —
- hire and provide internal training for a bilingual victim assistant.
- send the victim assistant to OVW approved training.
-implement policies to ensure that Intimate Partner DV and stalking victims receive timely
contact to increase victim engagement.
- work with the YWCA and State disability offices to create an accessible victim packet of
materials and will implement a policy to ensure every walk in victim receives the packet of
information.
-collaborate to create an officer training based on past reports that examine preconceived
notions and biases concerning DV victims
-track numbers following the training to measure any increase in referrals for charging .
- The YWCA will
-provide training (3 days) including attending the victim awareness class and (3 days) training
on the administration of the DA-LE.
- collaborate with the prosecution to create resource list to include in the victim packet
- collaborate to create an officer training based on past reports that examine preconceived
notions and biases concerning DV victims.
El Demonstrate a commitment on the part of all partners to work together to achieve stated project
goals and to sustain the project once grant funds are no longer available.
1) The City of Yakima will track project goals and case outcomes to demonstrate to City funders
the need for the additional victim services capacity.

Memorandum of Understanding would coincide with the grant period, anticipated to be 01/01/2025
through 12/31/2027.
VI) Commitment to Partnership
1) The collaboration service area includes the City of Yakima, Washington.
2) The partners agree to collaborate and provide enhanced victim assistant services to victims of
Intimate partner DV and stalking crimes pursuant to the program narrative of the grant application
attached to this agreement.
3) Compensation for [non -lead] partners' contribution to this project will be provided as outlined in the
attached OVW budget detail worksheet.
4) We, the undersigned have read and agree with this MOLL Further, we have reviewed the
proposed project and approve it.

AMENDMENT TO MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY
OF YAKIMA AND THE YWCA YAKIMA
THIS AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING
executed by Dave Zabell and Cheri Kilty in April of 2024 is made and entered into by and
between THE City of YAKIMA (City), a Washington State Municipal Corporation and YWCA
Yakima (YWCA), a nonprofit domestic violence victim service provider located in Yakima
Washington.
WHEREAS, the parties entered into a Memorandum of Understanding (MOU) for the
purposes of defming a collaboration to apply for an OVW EIP GRANT; and
WHEREAS, the City was selected to receive the OVW EIP GRANT; and
WHEREAS, all terms of the previously executed MOU remain the same with the
exception of the budget; and
NOW, THEREFORE, in consideration of the mutual covenants, promises, and
agreements set forth herein, it is agreed by and between the City and theYWCA as follows:
Budget attachment to the original Memorandum Of Understanding executed in April 2024 is
amended and replaced by Attachment A to this Amendment.
Except as expressly modified herein, all other terms and conditions of the original MOU remain
in full force and effect. This Amendment may be signed in multiple parts.
